David Hamilton of Dalserf here treated is the son of Sir John Hamilton of Cadzow, and the brother of Sir James Hamilton of Cadzow. On 6 September 1413 he and his brother Sir James had a safe conduct to travel into England. Hamilton Memoirs, p. 50

The Lands of Dalserf

Sir James Hamilton of Cadzow gave Dalserf, part of his barony of Machan. to his younger brother David, Ibidem, p. 52 but it was escheated to the crown because Sir James made his gift without the consent of the King, who was a prisoner in England at the time. The superiority of Dalserf was subsequently given to David's nephew James Hamilton of Cadzow, afterwards James, Lord Hamilton, by a charter under the Great Seal of Scotland dated 18 April 1426. RMS: 44 It would appear, therefore, that James, Lord Hamilton, and his descendants, were the capital lords of the fee of Dalserf, and that David Hamilton amd his descendants were mense lords.

Lanark; - ad regem spectantes ratione eschaete - ex eo quod predictus Jac. de H. dictas terras fe facto contulit David de H, fratri suo, per cartam sub sigillo suo, ac ipsum saisiri fecit corporaliter in eisdem, absque consensu regis seu gubernatoris in absentia regis, sive confirmatione quacunque debita de eisdem : - Tenend. dicto Jac. et heredibus ejus in feodo.
