She married (1) Robert Charlesworth Abt 1718. He was born Abt 1650, and died Bef 22 Jun 1745 in Amelia, Virginia.

The Will of Robert Foster, signed 06 Jan 1715/6, probated 22 Feb 1715/6, names:
- To son Robert Jr., the plantation where he ( Robert Sr.) lives, his mother to have use of it for five to six years
- To sons James and John "land where I Dwelt: to be divided between them James to have his choice",
- To Barby Loving one shilling and to her son Richard Loving "one heighfer with Calve named Rasberry". To her husband "all he is indebted to me"
- To my three youngest children, Margaret, Elizabeth and Anthony. Each of them a Gold Ring
- To "my son Richard my pistols and holsters and sword and feather bed and bolser and a Cow and a heighfer".
- To my three sons George, Thomas and William each a cow and a heifer.
- ""Exors: Wife Elizabeth and sons Robert and James
Because the will leaves the plantation to Robert Jr. and the English practice of Primogeniture was practiced, Robert Jr. must be the oldest son.

Elizabeth (Garnett) Foster, widow of Robert Foster married Robert Charlesworth in Essex County, abt 1716. They are found in several legal records in Essex County after that time. They were living in that part of Essex County that became Caroline County and consequently several records of transactions are found in Caroline County until 1736.
On 13 Feb 1719 Robert Charlesworth bought 150 acres of land from their step-grandson, John Foster, Jr. He paid John Jr 400 pounds of tobacco. The land was on Gilson Run, Essex County. They sold the land 7 May 1720 to James Garnett of King and Queen County for 5L and 5s.
The next record we find are in Caroline County. They had changed counties and never moved out of their home. We continue to find the name Robert Charlesworth in the Caroline County records until 1736. On 14 Nov 1735 it was ordered the he be free from paying county levy. He was probably was old and exempt. He probably died shortly thereafter. From all indication Elizabeth died after 1741 in Caroline County
