In 1716 (during her third marriage) Mrs. Frances Wynne was still executrix of (her first husband’s) Herbert’s estate. She made her own will on 16 October 1725, probated 4 March 1726/7.[5]

His will, 16 January 1706/7, with a codicil 14 February 1706/7, was proven 15 October 1725. In his will he named his issue: Thomas, James Powell, Brazure, Mary, and Elizabeth. These were all children by his first wife, Mary Brasseur of Nansemond, daughter of John Brasseur and Mary Pitt.[6]
