About Jacob Gearhart

In the name of God Amen I, Jacob Gerhart, being very weak in body but perfect of mind and memory, thank be unto the Lord. Therefore, calling unto mind the mortality of men and that it is appointed for all ___ to die, ____ this to be my last will and testamend. That in the first place I give and recomand, my soul into the hand of the almighty and therefore God of whom I have received, and my body to the earth from whence it came to be buried in a Christian D______ and like manner, not doubting at the day of ressurection to receive them gloriously again. Concerning my worldly estate wher____ it hathe pleased God to bless me with in this world, I give divise and dispose of in the following manner, viz.

First of all I give and bequet unto my dear and beloveth wife Elisabeth, (after my debts and funeral charges is paid) all the right and liberty of all ____ is in being of my estate during the gies by the name of Gerhart's widow, but if she should ____ to propose to hir second mariage she must content herself with the one third of the moveables and further the houshold furniture made to her intyerly.

___ as my son Jacob Gerhart has had one hundred pounds of my estate paid to him in hand, it is my order that after my diseas, he is to have one of my horses which he please for his birth right and ______ him ____.

And be it further a___ed ______ that after my disease, ___________________________ or second mariage each one of my daughters, namly Elsa Anderson, Margreth Smith, Mary Dils, Ana Peske to have fourty pound money, at eight shillings thirty in maner as followeth, forty pounds the first year, to each of them ten, and so each year til paid, and when the both apparrent dead or the mother proceeds to mery again.

Jacob Hummer and Jacob Himrey, two of the witnesses to the within will and above codicel being duly sworn on the Holy Evangelist of Almighty God did depose and say that they saw Jacob Gerheart, the testator, therein named sign and seal the same, and heard him publish pronounce and declare the within writing to be his last will and testament and that at the doing thereof the said testator was of sound disposing mind and memory as far as these deponants know and verily believe, and that David Fetter the other subscribing evidence were present at the same time and signed his name as witness to said will together with these deponants, in the presence of the testator.

Reading, Soragate his Jacob H Himry mark George Kerheart only acting executor of the within last will and testament of Jacob Kerheart deceased, being duly sworn on the holy evangelist of Almighty God did depose and say that the within instrument contains the true last will and testament of Jacob Kerheart the testator - therein named as far as he knows and _______ believes, and that he will well and truly perform the same by paying first the debts of the deceased and then the legacies in the said testament specified as far as the goods, chattles and credits of the deceased of the said deceased can thereto extend, and that he will make and exhibit into the Sorogative office at _________ inventory of all and singular the goods, chattles, and credits of the deceased that have or shall come to his knowledge or possession or to the knowledge or possession of any other person or persons for his use, and render a just and true account when thereunto lawfully required.
