WILL OF JAMES ZACHRY

RICHMOND COUNTY, GEORGIA; 1790

In the name of God amen.
I James Zachry of the County of Richmond in the said State, being of perfect mind & memory, blefsed be God for the same, do make, ordain and constitute this my last Will and Testament, in the words following Vizt. Imprimus, I give and bequeath to my dearly beloved Wife Mary Zachry All the Tract of land I now live on, containing Two hundred acres, be the same more or lefs, lying and being in the said County of Richmond on both sides of the Uchee Creek, together with all my personal estate consisting of Two Negroes named James & Sarah, with their future increase, Horses Cows Sheep & Hogs, farming utensils, and House-Hold goods except one feather bed , which shall be hereafter named, all during the natural life of my said Wife, Subjected to the maintenance of my Daughter Betty, an Idiot.

Secondly, - I give and bequeath to my Son William Zachry, his Heirs and afsigns for ever, two hundred acres of land, lying on the waters of the Uchee Creek which he now lives on being part of a Tract of Four hundred acres:

Thirdly. I give and bequeath to my Daughter Mary Tinsly, Her Heirs and afsigns for ever, fifty Acres of land, being part of the said tract Containing four hundred Acres. Also one hundred acres of land on Savannah River Joining lands formerly Laramours and Millins.

Fourthly - I give and bequeath to James Blackstone and John Blackstone, one hundred & fifty acres of land being the ballance and part of the above mentioned Tract of Four hundred acres of land that my Son William now lives on; and to their Heirs and afsigns for ever.

Fifthly; I give and bequeath to my Daughter Betty, one feather bed & furniture, and to her heirs and afsigns for ever. Also should my Dear Daughter Betty Survive the death of my dearly beloved Wife then and in that case, the said Tract of land and Negroes, already bequeathed to my said Wife shall be vested in her during her natural life.

Sixthly; After the decease of my said Wife and my Daughter Betty; I give and bequeath to William Yarbrough and James Yarbrough my Grand Sons and lawful Sons of Littleton Yarbrough, All that Tract of land that I now live on and already bequeathed to my said Wife and Daughter Betty, to be equally divided between them, Share and Share alike, and to their Heirs and afsigns for ever.

Seventhly, It is my will & pleasure, that after the Decease of my said Wife, All the personal estate then Remaining (except the Two Negroes, James & Sarh already bequeathed) to be publicly vended, and the monies arrising therefrom to be equally divided among all my Children, that is to say, John Zachary, Winifred Blackstone, James Zachary, deceased, William Zachary, Pelethal Adams, Mary Tinsley, Betty Zachary & Martha Yarbrough, Share and Share alike to them and their Heirs for ever. Likewise, After the death of my dearly beloved Wife and dear Daughter Betty, the Negroes aforesaid, are to be publicly vended and the monies arrising to be equally divided among all my Children, Share and Share alike, as aforesaid.

And lastly; I do ordain, constitute & appoint my Dearly beloved Wife Mary Zachry my Sole and entire Executrix, to receive all debts due, and to pay all Legal demands against my estate; Given under my hand and seal the Twentieth day of January one thousand Seven hundred and Ninety.

Richmond County, Ss Micah McDonough & Daniel Elam being duly Sworn saith that they were present & saw James Zachry sign & seal the above instrument of writing & deliver it as his last will and Testament for the purposes therein inprefsed, that they believed the said James to be at that time of sound memory , & that that they together with Bettyann Tindell Subscribed their names as witnefses in presence of each other & in presence of the Testator. 8th March 1790.

It is believed that this family moved to Richmond County, GA before the Revolutionary War. One account said they were in South Carolina during the war; and they may have moved there to escape the war in Georgia as many others did. The earliest record found is dated November 3, 1783 for a 200 acre survey on the "waters of the Ucha" (Uchee). There is a record in the Ledger of the Auditor General 1782-1792, Treasury Dept. State Revolutionary Payroll, February 13, 1784 showing James as having been paid four pounds "for providing provision, etc", during the war.On October 4, 1784 a plat of land for James Zachry shows a warrant for 400 acres of mixed land on "waters of Kiokas and Euche Creeks" (Kiokee and Uchee), adjoining the lands of James Tinsley, John Youngblood and William Barnett. There is a record or March 15, 1787 showing two hundred acre grant adjoining lands of Low and Walker, land on the east and William Tindall on the south; on March 22, 1787 the 400 acre grant adjoining William Barnett and James Zachry land on the east, James Tinsley and vacant land to the south with John Youngblood on the west. The river divided the 200 acre tract and it was here that the Zachry's made their home. Son William lived on the other acreage as did some of the other children. On Jan 20, 1790 James made his will, which was proved March 8, 1790. The will was signed, sealed and delivered in the presence of Daniel Elam, Micah McDonough, Betty Ann Tindell. The estate appraisal was made by Anderson Crawford, John Booker and David Walker with the help of Mary Zachry (James' wife). The inventory included farm tools, cooper and carpenter tools, candle molds, a shot gun, old pewter, tanned leather, feather beds, furniture, one large Bible and books, farm animals, a looking glass with the total amounting to 177 pounds, 12 ounces, 7 shillings. James is buried on his property which consisted of 10 yards or a square graveyard on land that in 1809 belonged to Bird B. Tindell, purchased from William P. Beall, located on the Uchee Creek. Mary is probably also buried there as well as possibly other members of the family.
