ACCIDENT NO. 36 — May 13, 1909 - Louis Musso, Louis Rosso, John Dajcman, Red Jacket Shaft, C.&H.

A fall of vein rock at the 65th level, North of No. 4, Red Jacket Shaft, was the cause of a sad accident costing the lives of three men. Two of whom were Italians and the other an Austrian.

An inquest was held before Justice Fisher and the following witnesses testified:

August Strand: "I was working with the men that were killed. We were throwing down dirt and getting ready to put up timber. It was some where about 3 o'clock and we were working away as usual. In the forenoon we tried the ground and again in the afternoon, with 2 or 3 bars. I have worked underground a great many years and was sure nothing could happen in that place. I was right among the men when the ground came away. We were getting ready to put up a heaving pole, we had just taken the measurement for the pole and the ground fell. When I heard the wind caused by the ground falling, I put myself behind a battery and was safe. There was room only for the battery we were going to put in; it was timbered right up close. The hanging was good. It was vein-rock that fell. ”

The above testimony was corroborated by three other witnesses.

Verdict: "That, the said Louis Musso, Louis Rosso and John Dajcman, came to their deaths, on the 13th day of May, 1909, by a fall of vein-rock, at the 65th level, North of No. 4, Red Jacket Shaft."
