Son of Joachim and Barbara (Eisenschimmel) Sabath, husband of Regina Mayer.
He applied for a passport on May 5, 1922 and his identity was attested to by his brother, Congressman Adolph J. Sabath, U.S. Representative for Illinois.
According to that document, he was born at Zabori in Bohemia (now within the Strakonice district in the Czech Republic), and came to the US with his family aboard the 'Werra' on May 18, 1885, having sailed from Bremen.
His parents settled at Chicago, where he studied law and, like his brother, was admitted to the bar.
