He was transferred out on 4/6/1862, transferred into VA Fredericksburg Light Artillery. Detailed 3/15/1863, acting as Adjutant for Col R. L. Walker; Returned 6/15/1864. He was discharged for promotion on 8/15/1864; commissioned into "C" Co. VA 13th Battalion Light Artillery. Promoted to Sergeant Major 9/7/1864. Wounded 9/15/1864, shot through left lung. Promoted to Lieutenant 10/15/1864, "for valor and skill". Commanding Battery 11/15/1864. POW 4/6/1865 Sailor's Creek, VA.; Confined 4/15/1865 Old Capitol Prison, Washington, DC.; Confined 4/17/1865 Johnson's Island, OH.; Oath Allegiance 6/1/1865 Johnson's Island, OH., released.
Postwar he lived in Fredericksburg, Va.: 1st at 613 Main Street, later at 401 Hanover Street; attorney, main partner in the law office of "Marye & Fitzhugh", located at 801 Princess Anne at the corner of Hanover Street (still practicing law in 1921); part-owner of the Eagle Shoe Co., located at Hanover Street above Main Street.
