Catherine Berger Fortney was a lady to admire. Widowed at the age of 40, she had six children, the oldest being 15 and the youngest about two. In addition she was expecting her seventh

child who was born early the next spring. She must have been a capable business woman for she purchased 436 acres in 1755 and in 1761 she purchased additional land. According to the laws of the time, sons Henry and David came into possession of Deer Spring when they reached legal age. We know that Catherine was the daughter of Andreas Berger for the two of them sponsored the baptism of the son Jacob of Philip Kunz in September of 1754 where the records list her as the daughter of Andreas and the widow of Henry. Catherine Fortney died in 1794, leaving a will that indicated substantial means. She never remarried and one can only wonder about those years after her husband tragically died by lightning strike.

They had the following children:

Will of Catherine Fortney

In the name of God Amen: I, Catarine Fortney of Frederick County, Sta te of Maryland being of perfect memory but sick and weak in body and knowi ng it is appointed for all men to dye. I therefore recommend my soul in t he hands of the Almighty God that gave it and my body to the earth to be b uried in a Christian like manner and as for the worldly estate wherwi th it pleased God to bless me with in this world life I give and bequea th thereof in the following manner:

Imprimis: I give and bequeath all my eateat both real and personal un to my son Daneil Fortney and my daughter Charity Runner alias Lafer, und er such exceptions as hereafter may be proved to their and their heirs.

Item: My will and desire is that my son Henry Fortney shall receive seven ty pound current monty and daughter Christina Galman, and daughter Catheri ne Hoff seventy pounds money likewise.

Item: I gie and bequeath unto my son Peter Fortney fifty seven acres of la nd, it being the land he now possesses or live on with all privileges ther eto belonging, to be his and heirs forever.

Item: I give unto Peter Fortney and Daile Fortney my grandsons twenty fi ve pounds current monty to be paid to them when they arrive to the lawf ul age of twnty one years and if their should dye before they should co me to that age, then the sruvifor to receive the same, the said Peter a nd Daiel being sons of my son Daniel.

Item: I give unto my grand daughter Catharine Fortney daughter of Dani el Fortney, ten pounds current money, a good feather (bed) and all there to belonging one cow, one new chest, one large ironkettle, one tea kettl e, one pewter tea pot, one tea pot, cups and saucers, wash bowl and one ta ble, one arm chair.

Item: My will is and my earnest desire that all my estate lands and chatt les whatsoever be equally divided between my son Daniel and my daughter Ch arity and their heirs but such legacy to be paid out to the same as is her etofore directed.

Item: It is my will that my son Daniel and his heris is to have the re st of such lands what is levft of the fifty seven acres I give Peter Fortn ey as herein mentioned what quantity yet unknown.

Item: My son Daniel I give one waggon, iron traises, one saddle, and in c ase of my son Daniel and my daughter Charity could not well agree in divid ing suh lands as is hereby given them, it is my earnest desire to be peace ably and choose such persons as they think proper to divide the same for t hem.

Lastly, I do hereby in theis my last will and testament appoint my son Dan iel Fortney and my trusty Neighbour and friend Francis Hoffman my executor s, revoking all other wills and testaments theretofore made and executed r atifying and confirming this my last will and testament.
