Matthias' will, which follows, was proved Proved October 22nd, 1783 in Berks County, PA

       In the Name of God, amen. I Mathias Loy of Greenwitch Town Ship in the county of Berks and Province of Pennsylvania being weak in Body but of Sound Memory Blessed be God, Do this Day and in the year of our Lord one Thousand and Seven Hundred and Sixty two Make and Publish this my last will and Testament in Manner Following, that is to say I give Unto my Eldest Son George Loy one Hundred and Fifty acres of Land or there a Bouts, that is to Say the hole premises where I now Live in with the appurtenances there Unto to have and to hould for Ever and also the named Mathias Loy so Long as he liveth or his wife Marry Loy they are to have of the Said Land and Premises So Long as they liveth Ten Bushels of wheate and also Twenty Bushels of Rie one year and every year and also two cows that is good in Milk and the(n) a sone named George Loy is to find feed for the said two cows Every Year and also two (?) that each of them will way one Hundred pounds a pees this yeare (unreadable) every year and also Fifty pounds of Beef every Year and also two Hundred of Eggs every year and also one Bushel of Salt and also half a pound of allspice half a pound of peper Every year and also the third row of apple trees and also two sheep the Choice of all the flock and also one Quarter of Acre of Flax Land with the Seed thereof and also half the Kitchengarden and that to be (unreadable) Every Year as it wants and also the said George Loy must take his fathers grain to the mill and Home againe according as he wants it and also the Said Mathias Loy after his Death in Case that he should Die his wife Marry Loy is to have half the above said grain Cattle mate fruits as Long as She Liveth but in cause if she Should marry a Nother man then all these Fruits and Cattle to be void and also the said Mathias Loy and his wife Mary Loy has Liberty to Live in the new House as long as they live and the said George Loy is to previde firewood for the Said House as long as his Father and mother Lives and also I give unto my Second Eldest Son Michel Loy one Hundred and Fifty acres of Land joyning Martain Keffer and George Kreamer which Land is Reckned to be worth Forty fore pounds and also to my third Eldest Son Adam Loy forty pounds to be paid yearly out of my Estate as followeth, that is to Say my Son George Loy must pay him ten pounds the third Day of January in the year of our Lord one Thousand Seven Hundred and Seventy Six and also the above Said George Loy must pay unto his Brother Adam Loy Ten pounds in the year of our Lord one Thousand Seven Hundred and Seventy Seven and also two sheep and my son George Loy must pay unto his Sister Margret Loy after his Fathers Death Twelve pounds and ten Shillings and also the Next Ensuing hear Twelve pounds and ten shillings and also to his sister Catherine the next ensuing year Twelve pounds and ten shillings and also his Sister Susan Twelve pounds and ten shillings and also the next ensuing year Twelve and ten shillings and Two cows and Two sheep that is to say when she is maried and also to his Sister Mary Twelve pounds and ten shillings and also the next ensuing year Twelve pounds and ten shillings and Two Cows and Two Sheep that is to say when She maries In this my Will Contained and (unreadable) my loving frends Over Seers of this my will Contained take care and see the Same performed according to my true Intent and Meaning and for their pains I give each of them in witness whereof I the said Mathias Loy have to this my Last Will and Testament Set my hand and Seal this 22nd Day of February in the Year of our Lord one thousand Seven Hundred & sixty two as and for his Last will and Testament in the Presence of Us who were Present at the Signing and Sealing thereof

       Note: According to "Early Palatine Emigration," by Knittle, a Lewis Leucht (pronounced loyct) emigrated from London to America with one son in 1709. This Lewis was a part of the earliest Palatine emigration. 

Note: We have much conflicting information on Matthias Loy/Ley. Some of it summarized here in haphazard fashion until we can get to the bottom of all of this.
Mathias' will was obtained from the Berks County Records Office in December of 1997 (see masterfile). It was made in 1762. In the will he provides for himself and his wife in their last years by giving the better part of his farm to his eldest son George, while they are to remain living there for there support. In the will he names his sons in order of birth as George, Michael, and Adam. George who gets 150 acres, and the house, and Michael who gets 150 acres of land, are to care for or divide property with their brother Adam, and sisters (probably named in order of age) Margaret, Catherine, Susan, and Mary. So it appears he gave up farming (possibly due to poor health) in 1762 becoming a tax collector, and living on another 21 years or so in the home he left to his eldest son, George.

       Greenwich Township, where Matthias made his will, was settled in 1749; incorporated in 1755 from Albany Township. 
       The Historical and Biographical Annals of Berks County Pennsylvania by Morton L. Montgomery in two volumes and published by J. H. Beers & Company of Chicago in 1909. In Montgomery's profile of a certain Walter S. Loy he states the following family tradition which confuses us a little more. 
       Walter S. Loy, a prosperous farmer and justice of the peace of Perry township, was born Nov. 8, 1850, in Windsor township, near Windsor Castle, Berks county, son of Joseph and Catherine (Smith) Loy. 
       The popular tradition that two brothers came from the Rhine Valley in Germany, is confirmed in this case by record, and tradition also has it that they were still single. On the same ship on which Matthias Loy emigrated in 1733 to the land of his adoption, was Anna Maria Ley (Loy), who is supposed to have been his sister, and who was then twenty-four years old. The other brother's name was Hans Jurick (George) Ley, who was then, in 1733, recorded as twenty-eight years old. He settled in Windsor township, and owned the farm of 220 acres now in possession of Joseph L. Smith. His wife was Barbara Bossart, of Windsor township, and they had children: Susanna, m. to John George Focht, who purchased Mr. Loy's farm; Molly, who died single; Jacob, m. to a Miss Billig, and father of Leah, Charles and Nathan; Charles, m. to Deborah Leiby, and father of Catherine, Henry W. and Alfred W. (m. Esther Anna Folk, and had two sons, Alfred B. and William D. F.).

       His wife's name is Anna Maria Day; she was born 27 February 1711 and died 14 December 1786 in Berks Co., PA. They left Rotterdam for London with a party of French immigrants on the Ship Samuel, 17 August 1733; he was then age 28 and she 
       age 24. [Their son Michael (1740-1823) m. Margaret Lempert (1743-1809).]{Ref. Pa. German Pioneers, by Ralph B. Strassburger and Wm. John Hinkle, Vol. 1 (1727-75), pp. 106-07.} Mathias was warantee for 100 acres in Philadelphia County in 1742 and before 1750 resided at Colebrookdale; in 1758 he was warantee for 50 acres in Berks County, residing midway between the present Bethel Zion's Church in Grimsville, Greenwich Twp. and the Wessnersville Church on the present paved road north from Krumsville (Schucker's Public School was on farm in 1949). His will dated 22 February 1762 was proved 23 October 1783; her will was signed 
       16 November 1786. He was tax colletor in 1763. 17 August 1733 he and his wife and his elder brother George "did this date subscribe to the oath of the Government" in court at Philadelphia.
