About Nicholas Powell

One report is that he died July 7, 1821 in Robeson Co. NC -- If this is the case he would have returned from MS. This has not been verified. He has a will in MS. This will could have been written before he left for a trip to NC if in fact he did go back to NC. It was common for some of the first families to go back and return with other relatives. About this time a Sam Dale had opened up trips that took two months one way. .

The log cabin that Nicholas first built in Marion County, MS was closer to the river than the house Evan built in 1836. The orginal cabin burned in a fire.

There was a Nicholas Powell in the Revolution Army and of Scotch Irish decent. Family tradition was that Nicholas was in the Army. However the Nicholas Powell that was granted land for his service died in 1804 and could not have been our Nicholas.

The Powell's knew the Ford's in NC. Lydia Powell married John Ford in NC and had a child on the trip to MS that died and was burried on the way. John Ford's uncle [?] also named John Ford was a Methodist Minister and built the John Ford House about 1798 on the west side of the Pearl River south of Columbia, MS. The house is still standing today.

Nicholas came by ox-wagon most likely south from NC to Augusta, then north to Nashville and then taking the new Federal Highway to New Orleans which was the same route Andrew Jackson took to New Orleans and which he had his men improve.

The trip took two years and was most likely sometime 1815-1816, buying land sold at Fort. St. Stephens Alabama when Mississippi was opened.

One story is they came "down the river" but it seems more logical that they followed or took the trail of Sam Dale who followed old Indian trails. Though it is possible they got on barges south of Chattanooga and took the Tennessee River for a way until they hit the new Federal Highway that Andrew Jackson had cleared.

This Federal Highway, is on the South side of Evan's property on which the Evan Powell home sits on the east side of the Pearl River. On the west side of the Pearl river is the historic Ford home where Pearl River Convention took place in 1817.

The Ford's had a sawmill from which Evan Powell got the lumber to build his house in 1836-37

"Niclas" Powell, 1 male under 10, 1 male 10-15, 1 male and 2 females 16-25, 1 male and 1 female over 45. [Nicholas was thus born before 1765.]

Land entries, patents, grants, and deeds to Nicholas Powell in Bladen and Robeson Counties, NC, need to be abstracted.

Grantor deed dated 12 JUL 1815 from Douglas, Nicholas, and Thomas Powell, personal property belonging to their deceased brother, Starling Powell [of Wayne Co., NC]. Robert Powell was a witness, Recorded in Robeson County. [This Robert Powell

was NOT a sibling.]

[Ann Powell was possibly a daughter of widowed daughter-in-law of either Douglas Powell, Jr., or Nicholas Powell, as these two owned land on Aspole Swamp.

She was possibly Ann, the widow of Jacob Powell. Ann, widow of Jacob Powell, was named in several grants and deeds in Robeson County between 1788 and 1797. These records need to be re-studied and abstracted.

Note that Evan, son of Nicholas, in 1839 married Mary Pittman in Marion Co., MS. Also on Ashpole Swamp was Elizabeth, apparent widow of Elijah Powell. Elizabeth was named as a "daughter" of Ambrose Powell in an 1814 deed.]

Grantor Deeds in Robeson County in 1818 (two) and 1819, need to be abstracted.

In 1817, Douglas, Nicholas, and Thomas Powell [heirs of Starling Powell] deed to Wm. & Benjamin Lewis. As administrator of the estate of Griffin Staton, Nicholas sold land on 6 AUG 1817.

Nicholas Powell and family migrated to Marion County, Mississippi, between AUG 1817 and the 1820 census of Marion County, MS.

1820 census, Marion Co., MS. Nicholas Powell: 1 male and 1 female over age 45, 1 male and 2 females age 15-25, and 1 male, under age 10. It seems there was a

married son or daughter with one child in his home in 1820. James Powell family also in Marion County; possibly a son. James and his wife were age 26-44, with 4 sons and 2 daughters under the age of 10. The 1850 census of James should be studied for his nativity.

There are two ways they could have come by wagon out of NC. Most likely they took the Fall Line Road out of NC until they reached Augusta. Later the trail would cross Georgia and Alabama, but at the time inland Georgia and Alabama was Indian Territory so at August they headed north through Chattanooga towards Nashville where they took the new Federal Hwy that Andrew Jackson had built after the Battle of New Orleans. This new Hwy runs on the south border of the property that Nicholas purchased and that his son Evan bought from his mother and then sold in 1839 to his son-in-law, John Ford.

WILL OF NICHOLAS POWELL

I, Nicholas Powell of the State of Mississippi and county of Marion being of of sound mind and memory do this seventh day of July in the year of our Lord one thousand eight hundred and twenty one make and publish this as my last will and testament in manner and form follows. It is my wish and desire that my Executors hereafter named, will as soon as practicable pay all my just depts; amongst which is the amount due the United States for the Section of land which I now live ---

  Item -- I give and bequeath onto my son Martin Powell and his heirs one Featherbed & furniture

Item -- I give and bequeath unto my son Percel Powell and his heirs one featherbed and furniture
Item-- I give and bequesth unto my daughter Edith Powell and her heirs one negro girl Owa, andn one featherbed and furniture.
Item -- I give and bequeath unto my Daughter Ann Powell and her heirs one negro Girl called Sarah and one featherbed and furniture.
Item -- I give and bequeath unto my son Evan Powell and his heirs my Shot Gun and one featherbed and furniture.
Item -- I give and bequeath unto my son Percel Powell and his heirs forever all that portion of my land whereon I now live lying on the North Side of Mays Creek the Run of said creed being the line.
Item -- I give and bequeath unto my son Evan Powell and his airs forever all that portion of my land which on I now live after the death of my wife Elizabeth, lying on the south side of Mays Creek, the Run of said Creek being the northern boundary.
Item -- I give and bequeath unto my children Martin Powell, Percel Powell, Edith Powell, Ann Powell and Evan Powell to each of them, their heirs two hundred and ninety dollars to be Raised and paid out of my Estate after the death of my wife Elizabeth.
Item -- I give and bequeath unto my wife Elizabeth for and during her natural life, all the lands which I own on the South Side of Mays Creek, with all siegroe -- horses, cattle, hogs, household and kitchen furniture and all monies and all other things otherwise divised, and it is my impress wish and will that at the death of my said wife not otherwise deceased be sold and out of the proceeds to pay the legaues before Specified......and the balance of the net proceed of the ....Estate....between my children Ancel Powell, Martin Powell, ....., Lydia Ford, Percel Powel, Edith Powell, Ann Powell and Evan Powell I do hearby make ordain and appoint my wife elizabeth and my Friend Gen Bengimin Lee Executors to this my last will and testament.
