Sir Robert FitzPayn

On the death of his maternal uncle Robert Fitzpayn, he acquired the FitzPayn estates, by virtue of a recent entailment. He was not the heir-at-law, since his uncle left a daughter, age 30, who was married and had issue. Nor can misogyny be blamed, since he was not the heir male, nor did the settlement create any remainders to heirs male.

He then assumed the surname FitzPayn. But he was never summoned to Parliament, notwithstanding that his wife was also the eventual heiress of her father Lord Bryan.

• Robert FitzPayn was born circa 1321.1 He was the son of Sir Richard de Grey and Joan FitzPayn.2 He married Elizabeth de Briene, daughter of Sir Guy de Briene, between 16 August 1351 and 16 October 1354.1 He died on 21 May 1393, an only daughter and heiress: without male issue.1
• Robert FitzPayn was baptised with the name of Robert de Grey.3 In 1354 he inherited his manors in Somerset and Dorset from his uncle, Sir Robert FitzPayn.1 In 1359 he accompanied King Edward III on the campaign in France.1 He lived at Wraxall, Dorset, England.1 He lived at Staple Fitzpaine, Somerset, England.1 He lived at Cary Fitzpaine, Somerset, England.1 He lived at Charlton Mackrell, Somerset, England.1 He lived at Cheddon Fitzpaine, Somerset, England.1

• ---------------------------------------------------------------------------------- When Robert Walerand died c. 1301 the Crown was in possession of Stogursey castle and borough, and the Crown retained control since Robert's brother and heir John was also an idiot. (fn. 17) In 1308 the king granted custody to Robert (III) FitzPayn of Poorstock (Dors.), and in the following year, on John's death, Robert retained the estate which, by the time of his death in 1315, he held in chief. (fn. 18) Robert (IV) FitzPayn, Lord FitzPayn, son of the last, died in 1354 leaving a widow Ela (d. 1356) and a daughter Isable. The estate passed on Ela's death to Robert's nephew Robert Grey of Codnor (Essex), who assumed the name FitzPayn. (fn. 19) His daughter and heir Isabel (d. 1394) married Richard Poynings, Lord Poynings (d. 1387), and Isabel's son Robert, Lord Poynings (d. 1446), was succeeded by his granddaughter Eleanor, daughter of Richard Poynings and wife of Henry Percy, later earl of Northumberland (d. 1461). Eleanor died in 1484 and was followed by her son Henry (d. 1489), Henry's son Henry Algernon (d. 1527), and Henry Algernon's son Henry (d. 1537), successive earls of Northumberland. (fn. 20) By 1514 the estate was described as the manors of Stogursey, Wyndeats, and Wick.

BARONY OF FITZPAYN (II) 1315

ROBERT (FITZPAYN), LORD FITZPAYN, son and heir, aged 28 and more, or 30 and more, at his father's death. He was knighted by the Prince of Wales, 22 May 1306, at Westminster. In 1310 he performed military service in place of his father. The King took his homage and he had livery of his father's lands, 5 November 1315.

The name of his 1st wife is unknown. He married, 2ndly (royal licence dated 29 June 1319), Ela, widow of John LE MARESCHAL, of Hingham, Hockering, and Buxton, Norfolk, and Aslackby, co. Lincoln, hereditary Marshal of Ireland (who was born 1 August 1292, and died 12 August 1316). In 1320 he conveyed the manors and advowsons of Worth and Okeford to himself and Ela his wife and the heirs male of their bodies, with remainder to his right heirs. On 30 May 1322 his lands, which had been taken into the King's hand because he had not come to the King in the march of Wales when ordered to do so, were restored to him, provisionally. He was with the King in his invasion of Scotland in August 1322, being in the retinue of the Earl of Arundel. In 1323 he conveyed the manors of Cary, Charlton, Rodway, Stogursey, Wraxall, Wootton, Marshwood, and Stourton, the hundreds of Cannington and Whitchurch, and the advowsons of Charlton, Wraxall, Wootton, and Stourton, to himself and Ela his wife, and his heirs. On 10 May 1323 the manor of Wisley, Surrey, which had been taken into the King's hand because Robert was an adherent of Bartholomew de Badelesmere, was restored to him, provisionally. In 1324 he and Ela his wife conveyed the manors of Stogursey, Rodway, Cary, Charlton, Wraxall, Staple, Okeford, Wisley, and Stourton, the hundred of Cannington, and the advowsons of Charlton, Wraxall, Staple, Okeford, and Stourton, to themselves and the heirs male of their bodies, with remainder to Robert, son of Richard de Grey of Codnor, remainder to Gilbert, brother of the same Robert son of Richard, in successive tail general, remainder to the right heirs of Robert fitz Payn. In 1327/8 they conveyed the manors and advowsons of Wootton, Frome Whitfield, and Marshwood, and the reversion of those of Worth (expectant on the death of Maud, late the wife of Robert fitz Payn le fitz, who held the same in dower), to themselves and the heirs of their bodies, with remainder to John Mautravers the younger, in fee: and the like reversion of the manor and advowson of Poole Keynes, to the same John Mautravers, in fee. He was summoned for Military Service from 20 February 1315/6 to 27 March 1335, to Councils, from May 1324 to 18 February 1346/7, and to Parliament from 3 December 1326 to 15 November 1351, by writs directed Roberto filio Pagani, fuitz Payn, or fitz Payn. In 1331 his wife, Ela, was convicted of adultery.[f] In March 1339/40 there appears to have been a false rumour of his death. On 20 May 1341 he was excused for not having attended the last Parliament, since he had been too infirm to come. In 1354 he made a final disposition of his property, and he and his wife Ela conveyed the manors and advowsons of Staple, Cheddon, and Charlton Mackrell, and the manors of Cary and Wraxall, to him and the heirs male of his body, with remainder to Robert (son of Richard de Grey of Codnor) and Elizabeth his wife, and the heirs of the body of the same Robert son of Richard, remainder to his own right heirs. He died 30 November 1354. On 20 December 1354 his widow obtained possession of the manors and advowsons of Stogursey, Rodway, Tatworth, Marshwood, Wootton, and Okeford, and the hundred of Cannington, by virtue of the fines levied in 17 Edward II and 1 Edward III, the escheator in cos. [f] On 5 Jan. 1331/2 the Bishop of Bath and Wells informed his metropolitan that he had carried out, as far as possible, the mandate he had received to punish Ela la Payne, wife of Sir Robert fitz Payn, who had been convicted of adultery. To a second mandate from the Archbishop, dated xv kal. Feb. following, stating that his former mandate had not been properly executed, the Bishop replied, 8 Mar., that, as far as he could learn, Ela had not lived in his diocese since he had received the first mandate, and that she could not be found. ROBERT FITZPAYN, son and heir apparent, by 1st wife. He married (contract dated at London, 2 May 1316, to marry at the Feast of St. James [25 July] following, Maud, sister and (afterwards) coheir of Sir Giles DE BADELESMERE, of Badlesmere and Chilham, Kent, Castle Combe, Wilts, &c. [LORD BADELFSMERE], and 2nd daughter of Sir Bartholomew DE BADELESMERE, of the same [LORD BADELESMERE], by Margaret, aunt and coheir of Thomas DE CLARE, and elder daughter of Sir Thomas DE CLARE, Lord of Inchiquin and Youghal. In March 13I9/20 he was about to go over seas with Edmund of Woodstock. He died s.p. and v.p. before 10 December 1322, and was buried in the Church of the Grey Friars at York (d). His widow, who held the manors of Poole Keynes and Worth in dower, married, before 27 March 1336, John (DE VEER), EARL OF OXFORD, who was born 12 March 1311/2, and died in France, 23 or 24 January 1359/60.
