Notes
Many printed and online genealogies give Tobias Willheit’s wife’s name as Catherine Walk. This is purely speculation. Tobias Wilhoit and Hans Martin Walk patented land together but this is not proof of that relationship and there is no actual evidence that Walk was really Catherine’s surname. Until Martin Walk’s German origins are found, there is no proof one way or the other that she was his sister as has been surmised (Research by Cary Anderson found a Hans Martin Walck born 18 January 1805 in Flinsbach. Elke Hall reports that DNA from Wolfgang Walk in Flinsbach did not match DNA results from two descendants of the Hans Martin Walk that settled in Virginia, suggesting that the this is not the correct Hans Martin Walck. Information from correspondence from Cary Anderson and Elke Hall to the author.). She certainly was not Hans Martin Walk’s daughter (Elke Hall, email correspondence to the author, citing Moravian Archives, Winston-Salem, North Carolina: Martin and Catherine Clore Walk's daughter Catherine wrote in her memoirs, "I was born of Lutheran parents on 27 August 1739 in Culpeper County, Virginia, and was baptized there by a Lutheran preacher. My mother passed out of time during my 6th year. After my father married, he moved to North Carolina during my 11th year and [we] lived not far from Abbots Creek. On 23 March 1756 I married the single Peter Frey, and we moved to the vicinity of Friedberg. Since the Brethren were at that time beginning to proclaim the Gospel hereabouts, we joined forces with them and in 1770 were added to the Society. We were received into the Church in 1774. Then in the year 1780 we attained the privilege of participating in Holy Communion. Although we had many distressing events to experience in our household, God's blessing was with us. Our marriage was blessed with 11 children - 5 sons and 6 daughters. Three of the sons, however, have preceded me into eternity. From those children still surviving I have lived to see 56 grandchildren and 12 great-grandchildren.").

15 May 1736 Tobias Wilhite made oath that he was imported into this Colony immediately from England and that it is the first time of proving his importation in order to obtain rights for Land (Orange County, Virginia Order Book 1 1734-1739: 72; County Clerk's Office, Orange, VA.).

20 July 1736 Tobias Willhide and Martin Walk granted 400 acres of land "in the great Fork of the Rappahannock River" for 40 shillings (Virginia Land Office, Grant Book 17: 127-128, Library of Virginia, Virginia Memory, (http://www.virginia.memory.com/collections/collections_by_topic: accessed 9 October 2013).)

24 Feb 1742 [O.S.] Tobias Willhite along with Courtney Broyle, Jacob Manspile, John Willhite & Jacob Miller German Protestants having produced under the hand of the Revd John Thompson Minister of St Marks Parish and George Samuel Klugg Minister of the German Congregation that within two Months last past they had received the Sacrament of ye Lords Supper and prayed that according to an Act made in the xiijth Year of our Sovereign Lord George the Second of Great Britain France and Scotland Being Defender of ye Faith & intituled an Act for naturalizing such forreign [sic] protestants and other therin Mentioned as are or shall settle in any of his Maties [sic] Colonies in America they might partake of ye benefits of that Act Its on their Motions ordered that they take the oaths prescribed by Act of parliament to be taken instead of the oaths of Allegiance and supremacy & the abjuration oath & subscribe to Test which they all Severally did in open court between the hours of nine & twelve in the forenoon. And its further orderered that the clerk give them a Certificate of their having taken the said oaths & subscribed the Test (Orange County, Virginia Order Book 3 1741-1743: 346; County Clerk's Office, Orange, VA.).

8 September 1745 Tobias [Willheit] along with Deiterich Weaver and John Willheit witnessed the will of Frederick Bumgardner, proved 27 February 1745 (Orange County, Virignia Will Book 2: 94; County Clerk's Office, Orange, VA.).

19 October 1745 Tobias Wilhoid and John Wilhoid natives of the Electorate of Mentz in German who have resided in this Colony upwards of seven years were naturalized at Williamsburg, Virginia (Certificates of Foreigners Naturalized in the Colony of Virginia the 19th & 23d of October 1745, V. 87: 196, Public Records Office, London, C.O. 5/1326. Beloved wife Catherine Wilhoit left all the rest of his estate during her widowhood, if she married one mare and increase, two cows, two ewes, two sows, a feather bed and furniture, a poplar chest, an iron pot, and a frying pan. If she died a widow all her part of the estate to be equally divided among the children except those that received land. Mary Broils, if she married what was mentioned to be taken out and the rest of the estate divided at the day of marriage. Youngest sons Jesse and William Wilhoite to have the land lent to wife Catharine to be equally divided between them. Wife Catharine and sons Michale and Connerate appointed executors. Tobias Willhoite's Will} In the name of God Amen I Tobias Wilhoit of the County of Culpeper and Parish of Brumfield being in perfect sences and Memary do make this my last will and Testament in manner an form following first I give my Soul into the hands of all mighty God that gave it hoping through the Merits of my Saviour to receive pardon of all my Sins and my Body I bequeath to the Earth in sure and Certaind hopes of the Resarection to Eternal life to be Decently Enterned at the Discretion of my Executrix & Executors hereafter Named -

Item I Leave to my two Sons Michael Wilhoite and ~ Conrade Wilhoit Two hundred of Acres of Land joining John Towles the open land & Robert Hucherson to be Laid of to the greatest Conveniancy of Both in Case they ~ Disagree for each to chuse a man to act for them Plead the sd to them and their hears forever ~

Item I Lend to my Beloved wife Catherine Wilhoit all the rest of my Estate During her Widowhood, in case she Marries, one Sorrell Mear and her Increase Two Cows to Yews two Sows one feather Bed and furniture a poplar chest one Iron Pot one frying pan in case she Dies a Widow all her part of my Estate to be Equally Divided among my Children Except those I have left Lands and Mary Broils, if she marries what is here mentioned to be taken out and the Rest of my Estate divided at the Day of Marriage

This said Will and fully proved by the oath of Henry Hill the other Witness thereto & Ordered to be recorded and on the Motion of Catharine Wilhote and Michael Wilhoite two of the Executors therein Named Certificate is granted them for obtaining a Probat they having Sworn to the same and given Bond According to Law Connerate Wilhoite the other Executor Came into Court and Refused to take the Burthen and Execution Thereof

It included an old horse, 12 hogs, 8 cattle, another horse, tools, 6 glass bottles, pewter, spinning and wooling wheels, beds, books, a parcel of hides, a “Dutch Pad Lock”, etc. (Culpeper County, Virginia Will Book A: 290-291; County Clerk's Office, Culpeper, VA.).
