This indenture of lease and release bearing dates 7th and 8th days of December in th seventh year of the reign of our gracious sovereign lord George by the grace of God of Great Britain, France and Ireland King, defender of the faith, and AD 1720 made between Christopher Dodgson of Ellingthorpe Grange in the parish of Gisburn in the country of York yeoman and Elizabeth his wife of the one part and William Dodgson of Ellingthorpe Grange aforesaid third son of the said Christopher Dodgson of the other part of or concerning all that messuage or dwelling house commonly called and known by the name of Woosen Gap together with all and singular houses, outhouses, edifices, barns, buildings, orchards, gardens, and backsides thereunto belonging. And also all those several closes of arable land, meadow and pasture with the appurtenances to the said messuage belonging and therewith occupied commonly called Woosey, Woosey Gill Heads and the Intack. And also one little close or croft called Lawrence Croft within which formerly stood two messuages or cottages. And also all those several closes of arable land, meadow and pasture called and known by the several names of the Carhamsike, Carham End, and the Carhams, formerly divided into two closes the Bickersber's, the Lower Lofterann with one barn or laithe therein standing, the Higher Lofterann and Wheat Lofterann, Hewitt Lofterann, the Mour Close formerly divided into five, several closes and the Jufield all which said premises are situate, lying and being within the township, town fields, permits and territories of Paythorne in the parish of Gisburn and formely purchased and taken in exchange of James Browne, Thomas Ayrton , Anthony Allonson, James Allonson, William Lancaster, and Robert Dodgson and do contain by estimation 39 acres and one rood of land be the same more or less which said indentures is witnessed by Ephraim Garthwaite of Gisburn schoolmaster, John .............. of Highfield in Lancashire .......... William Lancaster of Windy Pike and Richard Tetlow gentleman both in the parish of Gisburn. I WIlliam Dodgson of Paythorne in the Parish of Gisburn and County of York do for the settling, endowing and disposing of my Temporal Estate and Concerns make and ordain this my last Will and Testament leaving my Interment to the discretion of my Executors herein after named. And first it is my Will and Mind that all my just debts together with my Funeral Expenses Probate of this my Will and all other Incidental Charges be first paid and discharged out of my Real and Personal Estate both which I do hereby charge herewith. And after payment and Satisfaction thereof I Give Devise and Bequeath all the rest residue and Remainder of my Real and Personal Estate of what kind, Nature soever the same be unto John Coulton of Starbotton Yeoman and my Daughter Elizabeth his Wife and to their Heirs and Assigns for ever Charged and Chargeable nevertheless with the Payment of all my Debts And the several Annuities or Sums of Money hereinafter mentioned, that is to say, unto Mary my loving Wife the Sum of three Pounds to be paid to her at the end of One Month next after my Decease and after Payment thereof my said Estate is Charged and Chargeable with the payment of the Yearly Annuity or Sum of ten Pounds a Year of Lawful money of Great Britain to be paid to her by four Equal Quarterly Payments in each Year in Lieu and full satisfaction of her Dower and ? forth and out of my said Real Estate for and during the Term of her Natural life the first payment thereof to begin and be made at the end of three Months next after my decease And at death I do hereby also charge my said Real and Personal Estate with a Sum of Money sufficient to bury Mary my said Loving Wife in a Handsome [Hansom] decent and Christian like manner at the discretion of my Executors herein after named. Also it is my Will and mind and I do hereby charge my said Estate with the payment of the further Yearly Annuity or Sum of Four Pounds of Lawful money of Great Britain unto my Daughter Anne the Wife of Barnard Roberts of Holden Yeoman for the sole and separate use of her and her Children and that the said Husband Barnard Roberts shall have no power or Control over the same or any thing to do therewith but that he Receipt alone without her said Husband shall be to my Executors and Trustees from time to time a sufficient discharge for and during the life of my said Wife Mary. And after the Death and decease of my said Wife Mary then it is my Will and mind that my said Trustees and Executors shall pay unto my Daughter Anne forth and out of my said Estates the further Yearly Annuity or Sum of Five pounds which with the four pounds above charged makes up\the Sum of Nine Pounds for her sole and separate use without her said Husband having any power or Control over the same. And that her Receipt alone without her Husband shall be to my Executors and Trustees a sufficient discharge from time to time which is to be paid to her Yearly for and during the term of her Natural Life the said Yearly Sum of Four Pounds first mentioned to begin and be made at the end of Twelve Months after my decease. And the other Yearly payment of five pounds to begin and be made at the end of Twelve Months next after the death of Mary my said Wife And to continue Yearly till the death of the said Anne Roberts only. And after her decease it is my Will and Mind and I do hereby charge the said Estate and Promises with the Payment of One hundred and Eighty Pounds of Lawful Money of Great Britain to be paid to and equally divided amongst all and every the Children of my said Daughter Anne Roberts when and as the[y] Shall severally attain their respective Ages of Twenty one Years and after the death of their said Mother if it happen during the Minority of her Child or Children then her Children to have their Mother['s] Nine Pounds Yearly laid out by my Executors and Trustees for and towards their Maintenance and Education until the[y] attain their respective Ages of Twenty one Years at the discretion of my Executors herein after named. I also Give and bequeath unto my Granddaughter Ellin Coulton the Sum of One hundred pounds to be paid to her out of my Estates when she shall attain her Age of Twenty one Years. And for Non payment of the said Debts Annuities and Legacies above mentioned that it shall and may be lawful to and for my said Legatees to Enter unto and upon my Real Estates and hold the same till payment thereof be made and after payment hereof all the rest residue and Remainder of my Real and Personal Estates and Effects of what kind or nature soever the same be, I Give devise and Bequeath unto the said John Coulton and Elizabeth his Wife their Heirs Assigns for ever. Giving Security for the Annuities and Legacies above mentioned to let Set Sell or dispose of the said Estate to their own use and Benefit. And Lastly I do hereby Nominate and Appoint the said John Coulton and Elizabeth his Wife Executors of this my last Will and Testament hoping the[y] will faithfully perform the same as my Trust is in them/their ? Therefore I do hereby revoke and make Void all former and other Will and Wills by me at any time heretofore made and this only to stand and be for and as my last Will and Testament. In Witness whereof I the said William Dodgson the Testator have hereunto set my hand and Seal this Twenty third day of October in the Thirteenth Year of the Reign of King George the Second and in the Year of the Lord One Thousand Seven Hundred and Fifty Six.
