Now on this day comes the plaintiff in his own defense person and by attorney and also the defendant by her attorney and they sworally accounted themselves ready for trial.

And the same was submitted to the court setting as a jury for this cause. Where the petition of the plaintiff and the answer of the defendant.

And the court after hearing the evidence, and the cause and being fully advised in the presence of both. Find the plaintiff is innocent and the injured party, Be it therefore ordered and deemed by this court that the bonds of matrimony heretofrom existing between the said plaintiff and defendant and is hereby disolved. And held for naught. And that the plaintiff be restored to all the rights of a single person.

And the restrictions be removed from the defendant and that she be permitted to marry. And that the defendant have and recovers if and from the plaintiff all of her cost in this behalf paid out and the expenses in this cause.

in the War of the Rebellion, and served at least ninety days, and was HONORABLY DISCHARGED at

    That said disabilities are not due to his vicious habits, and are to the best of his knowledge and belief

Head of Ava, Mo., his true and lawful attorneys to prosecute his claim, and for  and in consideration of services done and to be in the premises, he hereby agrees to allow to allow said  attorneys a fee of ten dollars, which shall include all amounts to be paid for any services in the furtherance of said claim under the Act of June 27, 1890, and said fee shall not be demanded by or payable to said attorneys, in whole or in part, except in caseof the granting of a pension by the Commissioner of Pensions under the Act of June 27, 1890; and that the same shall be paid them in accordance withthe provisions of Section 4 of said Act and other laws pertaining thereto.

In the matter of of the claim for minor children of William J. Sisney, deceased of Co. B 16 Mo Cav

Personally came before me, a justice of the peace in and for the County and State aforesaid Grabeel Deatherage whose post office is Mountain Home, Baxter County, Arkansas aged 64 years, person of lawful age, who, being sworn, declared in relation to the aforesaid claim, as follows: I was personally acquainted with the said William J. Sisney several months before his death and was present when his death came on the 8th day of March 1903. I know he was dead for I saw him breathe his last breath and saw him dressed and layed outand know that he was dead and was pronounced dead by all that was present.

Also on this 9th day of November 1903 personally appeared before me a justice of the peace for the county and state aforesaid Dr F. M. Phillips whose post office address is via Baxter County, Ark. aged 46 years who being s?? declares in relation to the aforesaid claim as folows; viz I was called to see William J. Sisney on March 8 1903 and was with him on the day of 8th and left him on the morning of the 8th -- I was not present when he died. He was suffering with puritinitis (?) and his sudden death was due to heart failure. I was present when Mrs. Mary E. Sisney, wife of William J. Sisney, died. She died in child birth on Mar. 9 1901.

Uncovered portion of Declaration: top part mentions Marion, 1903 James B. Rhodes, childrens names, William J. Sisney enlisted at Lawrence Mills MO on the 15th day of August, 1862 in Co. B 16th Regt MO Cav..........and served at least ninety days in the war of the Rebellion; who was honorably discharged February 11th, 1863 and died March 8th 1903. That he left no widow survivng him.

That the names and dates of birth of all the surviving children of the soldier under sixteen years of age are as follows:

Virginia Sisney, born Mar 24th, 1888

Rosa Lee Sisney, born December 2nd, 1892

Lillie Sisney, born September 11th, 1893

Marget Ann Sisney, born May 10th, 1899 (s/b Margaret)

That the father was married under the name William J. Sisney to Tempy Potter, Sallly Sanders, Mary Turley, there being no legal barrier to such marriage.

That the declarant hereby appoints,

   KNOW YE, That whereas J.B. Rhodes has on this day, by the court of Probate in and for said County Baxter been appointed Guardian for Ben, Jack, Jennie, Rosa, Lilly, and Margaret Sisney___minors, under the age of 21 years, by his entering into Bond of the State of Arkansas for the use of said minors in the sum of One Thousand DOLLARS, and whereas, the said J. B. Rhodes has this day filed his Bond in such sum to the State of Arkansas, for the use of said minors, which said Bond stands approved by the Court. 

NOW, THEREFORE, The said J. B. Rhodes herby authorized and empowered to collect and receive all moneys, property and effects, that now are, or hereafter may become, due to his said Wards and in general to do and perform all and singular the duties devolving upon his as such Guardian by law, or that may be enjoined upon him by the lawful order, sentence or decree of any Court having competent jurisdiction.

As told by Jean Fisher (descendant of Amanda Sisney Huffman Petty Scot) ...Matilda's som William moved in with his daughter Amanda Rhodes and Matilda his mother, because he was having trouble with his wife. He never took care of Matilda as far as I know. He done well to take care of his self from what I've been able to find out.
