About Aucke Janse van Nuys

AUCKE JANSZ was probably born 1622 in Nuys, Groningen Province, Netnerlands, the son of Jan Goosens and Ebelken Hermans. Jan Goossens was born about 1581 in Dokkum, Friesland and was a cloth shearer when he married Ebelken Hermans at Amsterdam 24 December 1606. Ebelken was born about 1578 in Borkem, a German North Sea Island; daughter of Herman Jeus. (Centraal Bureau voor Genealogie, The Hague, Netherlands). Aucke Jansz died in Flatbush after 15 May 1694 when he made his will and before 1698 when the will was probated.

25 March 1645, banns for the first marriage of Aucke Jansz from Nuys, house carpenter, provided with consent of his mother, aged 23 years, living in Egelantiers Street, Amsterdam, and Magdalen Pieters from Alkmaar living in the above place, 22 years old, assisted by her mother, Adrientje Arents. The marriage was performed 25 April 1645. (Municipal Archives, Amsterdam)

According to Bergen (KCo) Aucke Jansz married about December 1666 Elizabeth Janse, widow of Christopher Shaets and Jan Claesen. His third marriage was to Geertje Gysbrechts, widow of Jan Jacobse.

In 1687 when they took the oath of allegiance at Flatbush to the British crown, Aucke Jansz and his son Jan Oake stated they had been in the colony 36 years, so they must have migrated in l651. (DHNY 1:659) At his first marriage Aucke had been listed as a house carpenter, but he probably did some farming also.

He lived first in New Amsterdam, where on 12 January 1653 Aucke Jans, carpenter, bought of Hendrick Gerritsen, tailor, a house and lot·on the west side of the Great Highway, containing in breadth 4 rods, in length, 3 rods l½ feet. (Icon 2:364; CDM 56). Aucke sold this property on 2 May the same year to Hendrick Hendricksen, the drummcr from Middleborch, but sued the purchaser on 14 July and after, for the rest of the purchase money. The defendent demanded a proper deed, claiming that the wall of the city diminished the size of the lot which is described as “a certain lot through which the city wall is made”. (RNA 1 : 86, 89, 97, 101,112). Apparently Aucke then rented a house from Sybout Claesen who sued him for rent which he was condemned to pay after defaulting three times. (RNA 1 : 399, 402, 408)

Aucke was involved in a number of other court cases. 10 February 1653 he sued the wife of Juryaen Andriesen for fl 24 for wages. She claimed he had damaged the work and the building more than he had earned. Two carpenters were appointed to inspect. RNA 1:50. However, a few days later Aucke was one of the two carpenters appointed to inspect a house built by Hendrick Gerritsen! (ibid 1:62)

That summer passed without a court case, but by 15 September 1653 Aucke was busy again in court being sued by P. Van Beeck for failure to start work on a house. He pleaded lack of materiaI and agreed to complete the work in three weeks if the plaintiff paid for the nails. The same day he was suing Augustyn Heermans on a contract for building the latter's house and suing Hendrick Hendricksen for balance already adjudged plus fl 10 for hogs delivered. He sued Hendrick Hendricksen again on 20 October for gl. 7 (RNA 1: 118, 119, 124; Icon 4:141). On 14 April arbitrators had been appointed to settle his dispute with Jannetie Juryans for fl 12 wages against her demand that he finish the work (RNA 1:82)

Auke also did work for the city. “The sheet - piling which was constructed at the graft or canal (Broad Street) by Auken Jansen and Christiaen Barentsen, carpenters, having again fallen down due to the heavy rain and water, the burgomasters and schepens contract with them for reconstructing it and bringing it again into good condition for the sum of gl 32 and agree to furnish them two good diggers”. (24 August 1654. RNA 1:231). When Stuyvesant went to the burghers for financial aid in the reconstruction of the fortifications on 12 October 1655, the record has been translated “Aucke Jansen, being aged, offers 1 or 2 days of work for the City". (RNA 1 : 371.) Since he lived 43 years after this date and was probably not yet 40 it seems scarcely possible that he was "aged".

By February of 1657 Aucke was residing at the Ferry where “Outie, house carpenter”, was assessed fl 6 for Domine Polhemius’ salary. (LNN 306). There, one of his jobs·was to enclose the Brooklyn RD churchyard because hogs were rooting up the graves, including that of his first wife.

As of 1665 Aucke Jansz was living in Flatlands (KCo), east of which he and Jacob Steendam had obtained a patent 12 November 1652. (CDNY 14:478). Bergen gives the impression that Aucke moved to Flatbush in 1669 and to New Utrecht in 1675 because he was assessed on 12 morgens in that town in 1675. Actually his farm was partially in each of the four towns: Flatbush, Flatlands, New Utrecht and Gravesend. He was a schepen of Flatbush in 1673 and one of its representatives to the convention at New Orange called by Governor Colve 26 March l674.There he took the oath of allegiance in l687.

One of the best known jobs Aucke did was the construction of the Dutch church at Flatbush, 1654-1660. On May 11, 1660 he brought a complaint: “With due respect Auke Janse carpenter on Long Island that he agreed with Domine Polhemius and Jan Strycker to build pursuant to the accompanying plan a church at Midwout on Long Island which work he has not only completed in accordance with·the said plan, but by order of the aforesaid he has done some other outside work, not covered by the plan… (they) now fail to pay to petitioner his well-earned wages under various frivolous pretexts, whereby they excessively wrong your petitioner, burdened with a 1arge family…”. He asked for arbitrators who were appointed. (CDNY 14:473-4) However, the final accounting (CDNY 14:483) shows: “To Aucke Jansen, carpenter, for outside work as appraised by arbitrators fl 100" as still unpaid. He was also one of the master builders of the parsonage erected by the towns for the Domine: "New Utrecht, on February 16 1679/80 paid 600 guilders for which Aucken Janse Van Nuyse, one of the master builders, in a receipt, gave thanks”. Aucke signed his name in two ways: as Aucke Jansen and as Aucke Jans Van Nuys. He used the latter when he signed the agreement concerning the children of his wife Lysbeth Jans by her former husbands.

Aucke was involved in a number of court cases that are all a matter of record. One case shows that despite the vaunted toleration of the Dutch there may have been some anti-Semitic feeling: Asser Levy had hired Aucke Jansen’s daughter till the f'ollowing May, but she had gone to work for the wife of' Balthazar Bayart. Aucke not being present when the case was presented , nor the following court day, on the third court day Levy stated that he had sent a legal letter to the court to notify Aucke that he must obey the order of 17 January, without result. Levy had also attached some money of Aucke’s held by Jan Brouwer, this attachment being declared valid. Aucke finally appeared in court on 21 February and declared Asser had told him he might take his daughter with him and look for another place for her whereupon Aucke had asked that she be kept 14 days there. She was not housekeeping, he said, and meanwhile he would look out for a place. This was not denied by Levy. Asser Levy said, "the maid was instigated by mischief-makers and produced a letter written to him by Aucke Jansen wherein he states that he understood from several that his daughter suffered much from him." The daughter was released from her contract by the court, Levy to release her clothes and to pay her wages for the time she had worked. Levy was given permission to institute defamation proceedings when and where he might wish. (RNA 5:176, 183, I88, 191)

The will of Auke Jans Van Nuyse made 15 May 1694, was proved 1698. (WNYHS) It left to eldest son John Auke procured by his lawful wife Magdalena(1) Auke £14; to all children by his first wife, deceased, and to children of his present wife, Geertie,(2) procured by her first husband John Jacobse that are named and baptized Auke, 6 shillings each. It left all else to his wife for life, then to the children by the first wife: Anatie wife of Dirck Janse Waertman; the two children of Geertie Auke dec’d procured by Joost Fransen, viz. Sara Joosten and Magdalena Joosten; Janettie Auke wife of Ryne Aertsen; Jan Auke; Pontus Auke; Abigail, wife of Lippit Peterse; Jacobus Auke; Famettie, wife of Jan Stevense; children of second wife by her first husband; Lysbeth Janse wife of .Dirck Jansc Sutphen; Eva Janse, wife of Jan Auke.

On May 6, 1653, he sold his house and lot in New Amsterdam, and in 1654 he was employed as master carpenter in the erection of the first church on Long Island, in Flatbush, near New Amsterdam.

There are records of purchases of several tracts of land in this region. In 1673 he was appointed Schepen or mag- istrate, by Governor Colve, an office similar to that of alderman of the present time, and in 1674 he was one of the representatives to the "Convention of Delegates" called by the governor to meet in New Orange (Albany) after the capture of the Netherlands from the British.

His name is in the list of those who in 1687 took the oath of allegiance to Great Britain after New Nether- lands had been re-taken by the British. A facsimile of his signature is given in Stiles' History of Kings County, New York, so we know that he was not an illiterate man.

He was three times married. His second marriage was to Lysbert Clausen and the third to Gurtruyd Jacobse.

Of his nine children five were born in America. The nine were Annetie, Gurtruyd, Janneke, Jan, Abagail. Pieter, Jacobus, Femitie and Ida. Very different names these from those borne by the descendants of the present day.

His will was dated May 15, 169 4 and probated in 1698.

7. JACOBUS. He married April 26, 1685, Maria Willemse Cornel of Flatbush, Long Island. He died in 1710.

Records show that he resided in Flatbush from 1688 to 1696, but he afterward settled in New Jersey. He did not remain there, however, as his will was probated in New Utrecht in 1710. The will gives the names of his children as William of New Utrecht, Johannes or Jan, Aucke, Isaac, Magdalena, Margarite, Elizabeth, Maria and Jacobus of New Jersey.

Van Nuyse, Aucke Jansen, the common ancestor of the Van Nuyse family, emigrated in 1651 from Amsterdam (there is a village named Nuis in Groningen), commonly writing his name and known as Aucke Janse; m. 1st Magdalena Pieterse; m. 2d, about Dec. 1666, Elizabeth Janse wid successively of Christopher Schaets and of Jan Claesen; m 3d Geertje Gyshrechts wid. of Jan Jacobse. page 9. Jacobus married April 26, 1685 to Maria Willemse Cornel of Flatbush, Long Island. he died in 1710. Records show that he resided in Flatbush from 1688 to 1696, but he afterward settled in New Jersey. He did not rmain ther, however, as his will was probated in New Utrecht in 1710. The will gives the names of his children as: 
1- William of New Utrecht. 2- Johannes or Jan. 3- Aucke. 4- Isaac. 5- Magdalena. 6- Magarite. 6- Elizabeth. 7- Maria. 8- Jacobus of New Jersey.

As far as we can learn, all the descendants of Jan, one of the two sons of Aucke Janse Van Nuys who had families, remained in New York and New Jersey, at least for several generations, as did also many of the fmaily of Jacobus, the other son, through whom we trace our lineage. However, some of Jacobus' family, who settled on the Raritan and Millstone rivers in New Jersey, by the fourth generation were emigrating to Kentucky. So we of the present generation of Vannices (in Iowa and Nebraska) must trace our ancestry thorugh the states of Indiana, Kentucky, New Jersey, New York, thence through Holland to France, from which country our forefathers fled at the time of the terrible Massacre of St. Bartholomew in 1572.

Notes: Forefathers of Aucke Janse Van Nuys fled from Franc e to Holland at the time of the Massacre of St. Bartholome w in 1572. His name appears in numerous records in the Ne w Amsterdam, Brooklyn and Flatbush area. On May 6, 1653 h e sold his house and lot in New Amsterdam, and in 1654 he w as employed as master carpenter in the erection of the firs t church on Long Island, in Flatbush, near New Amsterdam. T here are records of purchases of several tracts of land i n this region. In 1673 he was appointed Schepen or magistra te, by Governor Clove. In 1674 he was one of the representa tive to the "Convention of Delegate" called by the governo r to meet in New Orange after the capture of the Netherland s from the British. His name is in the list of those who i n 1687 took the oath of allegiance to Great Britian after N ew Netherlands had been re-taken by the British. He was thr ee times married. His second marriage was to Lysbert Clause n and the third to Gurtruyd Jacabse.

In December 1666 Aucke married as his second wife and as h er third husband ELIZABETH JANSE, the widow of Christophe r Schaets and Jan Claesen. Prior to 17 July 1681, prob. o n Long Island, NY, Aucke married as his third wife and as h er second husband GEERTJE GYSBRECHTS, widow of Jan Jacobsze n Van Rheenen.

Aucke emigrated to America from Amsterdam in 1651. He wa s a carpenter, residing at first in New Amsterdam, where o n 6 May 1653 he sold his house and lot to Hendrick Hendrick sen. In 1661 he resided at Brooklyn Ferry; in 1665 in Flat lands, and in 1669 in Flatbush, where he had built the chur ch in 1654 and 1660. He was appointed schepen in 1673 unde r Governor Clove, and took the oath of allegiance in 1687 . He was living in New Utrecht in 1675, where his name app ears on the assessment roll for that year. On 15 October 1 681, he bought of Bartel Claesen his house and farm in Flat bush of 19 morgens; also Claesen's share of the land lyin g at the Paerde Gat, patented by Governor Andro on 17 Marc h 1677 to said Claesen and Louis Jansen. He also purchase d 10 morgens on the plains of "Amersfoort," which Claesen b ought of Samuel Spicer; and also 2 morgens on the "Midwoute " plains known as No. 10, with salt-meadows. His will wa s dated 15 May 1694 and proved in 1698.
