1677-8 March 12: Scales, "Historical Memoranda concerning Persons and Places in Old Dover, NH p.383,"Benj. Yorke, aged about twenty three years," said that Smart had mowed, & c 10 years& that "my father mowed ye marsh of Robert Smart about ten years ago with ye leave of ye sd Robert smart,"& that Meder & Davis, &c. last hay time. 12 Mar. 1677-8"

DIRTY Brook. Mentioned March 19, 1693-4, when John Bickford had a grant of 60 acres on o' the south side of the durty brooke, going to the~ second falls," at the upper side of Benj/n York's land. John Bickford conveyed this land to John Smith Ap. 8, 1703, when dirty brook is again mentioned. Part of Johr Smith's grant of 50 acres, June 23. 1701, was laid out Ap. 3, 1705, "on the north side of the durty brook,' bounded one side by 'follet's path,' thence running westward to the brook. This land was near the second falls in Lamprey river. He had another grant of 20 acres Oct. 2, 1729, at the upper side of his grant of 1701, lying between Follet's bridge path and the dirty brook." It joined the lands of Burnum, Goddard, and Stevenson. Dirty brook is in the Packer's Falls district, Durham, and empties into the Moat. It once had sufficient power to run a shingle-mill.

DIVISION OF WOODLAND IN 1723. Notwithstanding the parcelling out of the land in 1688, an extensive area remained unassigned. Before 1661, the proprietor of every dwelling-house was a commoner, or entitled to a right in the common land. In 1757 there were 145 claims to these privileges acknowledged as valid. Shortly after 1700, numerous grants of land were voted to new comers. Several sub-divisions of their holdings were made by these commoners, the last apportionment of woodland being in 1723, when 217 lots within the bounds of the town were disposed of, the terms being such that about every male citizen who had attained his majority received a certain tract. In 1725 the unoccupied herbage land, amounting to 1325 acres, was distributed among the commoners.
