Will of Col John Bryan

In the name of God Amen; this 19th day of January 1781, I John Bryan of Craven Co in the State of NC, being sick and weak in body but perfect in mind and understanding do make and advise this to be my last will and testament in the following manner.

item , I give and bequeath to my two sons James and William Bryan all my land in Hyde County, equally to be divided between them, only my stock that has always been called theirs, to them and their heirs for ever.

item, I give and bequeath to my son John Bryan 400 a of land on Pearse's Creek and 1,000 a of land laying on the sand hills, where the house stands and the negro that is called his and a proportionable part of my stock to him and his heirs forever.

Item, I give and bequeath unto my son Lewis Bryan all that part of land where my field is layng on the north of Adams Creek up the branch to the head line and the negro that is called his and a proportionable part of my stock to him and his heirs forever.

Item, I give and bequeath unto my son Joseph Bryan all the rest of my land laying on Adam's Creek beginning on the first branch of Godfries' Creek and running across to Coate's Creek and the negro called his and a proportionable part of my stock to him and his heirs forever.

Item, I give and bequeath to my daughter, Mary Bryan 75 a. on the lower side of Tiner's Creek and one negro girl named Bet and her proportionable part of my stock to her and her heirs forever.

Item I give and bequeath unto my daughter Ann Bryan 40 a of land known as Fork Neck and 300 a. of land lying on the head of Bry River on the west side and a negro girl named Comfort and a proportionable part of my stock to her and her heirs forever.

Item I give and bequeath to my daughter Elizabeth Bryan 300 a of land known as Valentine's Neck and 60 a of land on the upper side of Goose Ck, which I bought of william Cato and one negro girl named ___ and her proportionable part of my stock to her and her heirs forever.

Item, I give and bequeath unto my dearly beloved wife, Elizabeth Bryan, four negroes known by names of dusty, Archelaus, Nell, and Rose to her and her heirs forever and the use of one of my plantations on Adam's creek during her life and a proportionable part of my stock lain off to her by my executor and all the remaining part of my estate to be equally divided among my children after my just debts being paid.

I likewise constitute, make and ordain John Emory and Francis Dawson executors of this my last will and testament disannulling all other wills and legacies before made by me.

Craven Co, March Court 1782. The foregoing last will and testament of John Bryan was duly proved by Joseph Crispin, one of the subscribing witnesses thereto, who swore that he did see the Testator sign, publish and Order the same to be and contain his last will and testament and at the time thereof the Testator was of sound and disposing mind and memory. John Emory and Francis Dawson, Esecutors therein named, qualified as such agreeable to law. Ordered Letters Testamentary be issued accordingly

(BE 12) JOHN BRYAN (William, Edward)

John Bryan married Elizabeth Oliver, the daughter of John and Mary (Shine) Oliver. John Bryan was a captain in the North Carolina militia and was killed at his home by the Tories March 12, 1782. His heirs were granted 640 acres of land because of their father’s service in the militia.

Elizabeth (Oliver) Bryan died after 1796.
