Either this Joseph Hawkins was a serial spouse, or he's been confused with the myriad of Joseph Hawkinses that were born in the relative area all at about the same time frame. I do not believe this Joseph Hawkins (married to Sarah Marlin with whom I have a DNA match to living Marlins) was the child of John Hawkins and Mary Long. They did indeed have a son born in 1712 by the name of Joseph, but their son deceased in 1769 in Spotsylvania, VA, whereas my ancestor died in or near Mount Jackson, Frederick County, VA on 28 Sep 1770, will proved on 4 Dec 1770.

Will the REAL Joseph Hawkins, Please Stand Up?

Based on the two very different wills given under the notes, what we have here is a CLEAR case of mistaken identity. One Joseph Hawkins was deleted through a merge and the one that survived is, I do believe, the son of a John and Mary Long Hawkins, who died in the spring of 1769, while my ancestor deceased in the fall of 1770. Point in case, the will for my ancestor lists his wife, Sarah Hawkins, three sons, Joseph, Jr. Benjamin and Samuel, plus two daughters, Mary and Elizabeth. While the other will for the decedent of 1769, mentions his Ex-wife, Jane. We really need to clarify this mess, if we can. They are TWO SEPARATE people.

He married Jane Nicholas. Joseph's will was dated 30 Mar 1769 in Spotsylvania County, VA. !Biographical sketch:Joseph and Jane owned various pieces of property in Spotsylvania County, VA. and are described in that county's deed books. He lived in Hanover County, VA. but had purchased land inherited from his sister Mary Craig. The property was originally purchased from Harry Beverly on the NE side of the Pamunkey River on both sides of Terry's Run which was then called the Jigging River. In 1769, he left land to wife Jane and son Joseph Jr. It was a "tract of land left by his father." Joseph Hawkins had a son John who may be the John Hawkins of Hanover County, VA. who married Mary Langford. One genealogist who has studied the VA. Hawkins families for many years believes that this is true. She has assembled many facts which lead to that conclusion. A descendant, Dr. J. Russell Hawkins of KY. believed that John of Hanover County, VA. came from England. Joseph Hawkins dated his will 30 Mar 1769 and was witnessed by Philomon, his son, and Charles Cosby and W. Robinson. The will P. 525 Will Book, Spotsylvania County, VA. reads "EX. wife Jane and sons John and Joseph. Leg. wife Jane, the tract of land left me by my father with that part of the land that I purchased from Bernard Moore, Gentleman: son Joseph land adjoining James Jones, Edward Coleman and other.: "..."my two daughters Lucy and Sarah Hawkins." Joseph Hawkins deceased, held a legal title of land in Orange County, VA. in 1770. William Hudson, Blacksmith, had the equitable. Larkin Chew mentioned the property in his will in Spotsylvania County, VA. (Farmer, p. 3)

WILL OF JOSEPH HAWKINS

In the name of God Amen. I, Joseph Hawkins of the County of Frederick and Colony of Virginia, being weak in body, but sound of memory, Blessed be God, do this second day of September in the year of our Lord one thousand seven hundred and seventy make and publish this my last Will and Testament in manner and form following viz: First I give to my dear wife, Sarah Hawkins, one featherbed and furniture and I do give to my son, Joseph Hawkins, the set of smith’s tools he is now at work with, and I leave all of my tracts of land to be sold by my executor within four years after my decease and in the meantime be rented from year to year till sold in order to pay the interest of my just … First, three hundred and ten acres which I now live on and two hundred and sixty-five acres which was formerly Richard Marlings and deeds to be made for it to the purchasers by my executors. And I leave all my other tracts of land that I hold to be divided equally among my three sons as the said tracts are now divided and if either of them should die without an heir, then the oldest living shall take possession of his part and sell it and equally divide it with his brothers and sisters or their heirs keeping an equal part for himself. The two tracts lying on the south side of the North River to be one tract and my son Joseph Hawkins to have the first choice of the three tracts and the other two, Benjamin Hawkins and Samuel Hawkins, to draw lots for their parts. And there are two surveys that I hold which are in dispute, and if I do obtain the deeds for them or that upon the River and whosoever shall have that survey for choice which is on the River shall have that tract in dispute joining on the river, if there shall be a deed obtained for it, and shall pay to each sister a sum of ten pounds current money to them or their heirs two years after they obtain possession thereof – and the other tract that is in dispute, if there shall be a deed obtained for it, shall be divided between the other two sons, and when my three sons comes of age to possess their land after one year they shall pay to their younger sisters Mary Hawkins and Elizabeth Hawkins ten pounds apiece current money each of them three. And after all of my just debts are paid, I leave the third part of what is left to my wife, Sarah Hawkins, to dispose of as she shall think proper. And I make and ordain her my said wife sole executor of this my Last Will and Testament in trust for the intents an purposes of this my last Will and Testament contained. In witness thereof, I, the said Joseph Hawkins, have to this my last Will and Testament set my hand and seal the day and year above written. Signed, sealed and delivered by the said Joseph Hawkins as for his last Will and Testament in the presence of us who were present at the signing and sealing thereof.

JOSEPH HAWKINS Edwin Young, George Ruddle, Rueben Allen, John Barrett –Witnesses.

Will proved Dec. 4, 1770; recorded in Frederick Co., Va, WB IV, Part 1, p. 51. Sarah Hawkins, executrix, gave bond for 1,000 pounds for George Ruddle and Edwin Young as her securities. Joseph Hawkins inventory in the same book, p. 178 listed more than 226 items and was appraised at 451 pounds. Debts of the estate paid by the executrix totaled 505 pounds, the principal items of which were Burr Harrison Dunham’s judgement for 185 pounds, (Capt.?) Lee’s two bonds for 90 pounds, and the account of Jacob Holman for 90 pounds.

Joseph Hawkins’ will mentioned his three sons and his two youngest daughters, Mary and Elizabeth. At least two of his daughters, Sarah and Rebecca, are assumed to have been of age or married by the date of the will. Some records also include another daughter, Rachel who married Peter Windle. 1. Benjamin and Magdalena had at least three children: a. John b. July 6, 1779. b. Sarah b. January 17, 1780 Shenandoah Co., Va; d. Oct. 11, 1865 Tenth Legion, Va., buried at Toll House Farm, five miles south of New Market, Va, the old home place of Valentine, the Immigrant. Sarah m. Page 527 of the "Sevier Family History" 1961 by Cora Bales Sevier and Nancy S. Madden states that Joseph Hawkins died in Hawkinstown. The Will, itself, was proved on 4 December 1770. It also states in the Will, that it was written on 2 September 1770.
