A date or place of death hs not been identified for Hugh Montgomery of Hessilhead. He was alive on 24 April 1596 NRS: GD148/258 but he appears to have died before 25 September 1602, when his son Robert, noticed as Robert Montgomery of Hessilhead, was served as heir to his deceased grandfather, John Montgomery of Hessilhead. 6 November 1572: Contract between Robert Montgomery, brother and heir to unquhile George Montgomery of Mainshill, on the one part and Andrew Montgomery, his brother on the other part with the consent of Hugh Montgomery of Hesilheid, Robert Ker of Kerrisland and Cuthbert Symple of Auchinbothie, their friends chosen by their mutual consents fro decision of all debates matters and causes amongst them; whereby the said Andrew Montgomery renounces all right to the lands of Maynshill in Beyth and also to the lands of Kirkland and Kirkhill of Stewarton within the barony of Kilwinning as also to the assignation amde by the said unquhile George to Andrew, his brother for redemption of the said lands dated 6 February 1565; for which causes Robert was to pay to Andrew, his brother 300 merks Scots; and if Robert Montgomery or his heirs should at any time sell the Kirkland of Stewarton and Kirkhill, they should pay Andrew Montgomery, his heirs or assignees 100 merks. 24 April 1596: Letters obtained at the instance of Alexander Cuninghame of Craigance and Elizabeth C., his spouse, for suspension of a charge at instance of Hew Montgomrie of Hissilheid (who alleges himself donator to the ward and nonentry of the lands of Auchinnames and the gift of marriage of Jean Crawfurd, daughter of deceased James Crawfurd of Auchinnames by said Elizabeth Coninghame) to produce said Jean Crawfurd unmarried. They plead that said Jean is over 14 years of age and cannot be exhibited without her own consent and that of her curators; and also that Patrick Crawfurd, now of Auchinnames, has used all means to dispossess said Jean of her right to succeed as heir to deceased James Crawfurd, her father. Hugh Montgomerie of Hessilhead, called by Crawford "Young Hugh," succeeded his father. He was a member of the famous Convention Parliament in 1560, which passed an act establishing the Reformed faith in Scotland. A trial took place, December, 1576, (as above,) in consequence of a feudal war between the Montgomeries of Scotston, who lived only about a mile from Hessilhead Castle, and the family of Hessilhead, in which Gabriel Montgomerie, of the Scotston family, was slain by some adherents of the other. The quarrel may have originated from the tocher of the mother of Scotston, who was a daughter of Hessilhead's grandfather, "Old Hugh," having been unpaid, at least for a long period, which appears by the confirmation of old Hugh's last will in 1564.

He married a daughter of Robert, fourth Lord Boyd, as appears from the will of her brother Robert Boyd of Badenheath, who died in 1611. A sister of hers was wife of Hugh, the fourth Earl of Eglinton. He left

  • I. Robert, his heir; and
  • II. Jean, who married Sir William Mure of Rowallan.

Robert Montgomerie of Hessilhead, was retoured heir to his father, September 25, 1602. He married Margaret, daughter of Robert Wallace of Dundon

Hugh Montgomerie of Hessilhead, called by Crawford "young Hugh." He was a member of the famous Convention Parliament, in 1560. A trial took place, 1st December, 1576, in consequence of a feudal war between the Montgomeries of Scotston, who lived only about a mile from Hessilhead Castle, and the family of Hessilhead, in which Gabriel Montgomerie, of the Scotston family, was slain by some adherents of Hessilhead. The quarrel may have originated from the tocher of the mother of the Scotstons, who was a daughter of Hessilhead's grandfather, old Hugh, having been unpaid, at least for a long period, which appears by the confirmation of old Hugh's last will, in 1564. However, the Lady Hessilhead having been barbarously assaulted by a servant of Gabriel Montgomerie, for slapping him on the face, so that her life was in danger, was the first offence borne on the record. Nothing, however, was done to either party by the law, and the prosecution seems to have expired without any result. Hugh Montgomerie of Hessilhead, according to Crawford, married Janet, daughter of Robert third Lord Semple. This, however, seems to be a mistake; for in the latter-will and testament of Robert Boyd of Badenheath, third son of the fourth Lord Boyd, who died in 1611, this entry occurs:—" Item, I leif to the Laird of Hessilheid, my sister seme, in ane rememberance, my signet of gold of ane vnce weicht, and my best stand of silk claithes to his sone, my god sone." It would thus appear that the Lady of Hugh Montgomerie of Hessilhead was a daughter of Lord Boyd.* He died before 25th September, 1602, when his son, Robert, was retoured his heir. His issue were—

  • 1. Robert, his heir.
  • 2. Jean Montgomerie—who is called in the "Memoirs of the Houseof Rowallan," Elizabeth—married Sir William Mure of Rowallan, and had issue.
  • 1. Sir William, born about 1594.
  • 2. Mr Hugh, preacher at Burston, in Norfolk.
  • 3. Marion, Lady Penkill, who is not said to have had issue.
