Evidence from the National Records of Scotland

31 August 1702: Note of lands contained in marriage and tailzie of James, lord Maitland, son of John, earl of Lauderdaill, and lady Jean Sutherland, eldest daughter of John, lord Strathnaver, including lands of Ugston, in constabulary of Haddington, lordship, barony and regality of Thirlestane, lands and barony of Stobo, Edlestoun, lands and lordship of Dunbar including lands of Westbarns, and others. 1) The James Maitland, son of John Maitland and Margaret Cunningham did not have any sons. According to The Peerage, https://www.thepeerage.com/p1559.htm

"Hon. James Maitland, Visccount Maitland (c. 1680 – 1709); eldest son of the 5th Earl, died without male issue" -

therefore he can't be the father of James Maitland Lauderdale, John W Lauderdale, Joseph Lauderdale, Robert Lauderdale or Roger Lauderdale.

(2) His birth and death facts are incorrect. b. circa 1680, d. 1709 (refer to The Peerage)

You can find the same facts on History-Clan Maitland's website. As well as the fact that because James Maitland had NO SONS, the Earldom passed to his younger brother Charles Maitland, (1688-1744) and 6th Earl Lauderdale, and later to Charles son' James Maitland (1718-1789) 7th Earl of Lauderdale.

James, Lord Maitland, who predeceased his father in 1709. He married (contract 31 August 1702) Jean Sutherland, daughter of John, fifteenth Earl of Sutherland. By her, who died 11 February 1747, he had an only daughter, Jean, born 7 December 1703, married (contract dated 3 and 8 September 1726) to Sir James Fergusson, second Baronet of Kilkerran, who became a Lord of Session in 1735, and died 4 April 1766,3 leaving issue.
