James Whaley was born ca 1720 in Virginia, possibly the son of Ann (unknown) and James.

He married Hannah Higgerson in 8 July 1739 at Overwharton Parish, Stafford Co, Virginia[2]. They had four children together. Hannah died after the birth of Elizabeth.

He then married Penelope King and they had ten children together.

James held land on Broad Run in tenancy for Robert Carter, Esq. He died before 10 Oct 1785, the date of probate, in Cameron Parish, Loudoun, Virginia, United States, at the age of 65.

  • "In the Name of God Amen.
  • I, James Whaley, of the County of Loudoun of State of Virginia, being sick and weake of Body, but of sound sense and memory and calling to mind my mortal state that it is appointed for all men once to die do make this my last will and Testament in manner following,
  • Viz, I give to my son James Whaley</b> two Negroes Viz, Jack and Lish,* to him and to his heirs forever,
  • Item I give to my Daughter Elizabeth Robertson one Negro Boy Named George now in her possession for and During her natural life and after her decease to her Daughter Hannah Robertson and her heirs forever,
  • Item I Give to my Daughter Hannah Carter one shilling sterling money,
  • Item I Give to my Daughter Anne More one shilling sterling money,

Also I give to my Daughter Sarah, the Bed of Furniture she now lies on, the Walnut Table, the small Trunk, the Sorrel Mare, Chest of Draws, Looking Glas, Loom and Gun, to her and her heirs forever,

  • Item All the remaining part of my Estate both real and personal Debts and Tobacoe I give to my Four youngest Children Viz, Vincet Whaley, Levy Whaley, Winnafred Whaley, and Amelia Whaley, to be raised on till they come of age to take care of themselves and everything of the said four Childrens and my Daughter Sarah, to remain on the Plantation as there are at this present time.
  • My Will and Desire is that my son William Whaley to be in his possession my aforesaid four youngest Children and there respective Estates and bring them up in the best manner there Estates will allow and when my Daughter Amelia comes to the age of sixteen years, then my Estate is to be Divided equally the aforesaid Four Children My Will and Desire is that if my Daughter Sarah should marry before Amelia Comes of Age, then she shall pay the whole rent of Boath halves of the Plantation to make a Compensation for William taking Care of the Children for and during the time William has Care of the Children and no longer. Lastly I appoint my son William Whaley to be the Executor of this my last will and Testement revoking and annulling all other wills heretofore made by me. In Witness hereof I have here unto set my hand and seal this 25th Day of March 1785.

  • At a court held for Loudoun County, October the 12th, 1785:
  • "This will was proved by the Oath of James Jennings and ordered to be Certified and on the motion of William Whaley who made according to Law Certificate is granted him for obtaining a probate thereof In due form giving Security whereupon he with Osborne King, John King & Henry Talbott his securites entered into and acknowledged there bond in the penalty of One thousand pounds Conditioned as the Law directs and at another Court held for the said County the 14th day of April 1800 this will was full proved by Scarlett Berkeley the other subscribing Witness and ordered to be recorded."
