About Joel I. Halbert, Sr

William and Mary Halbert had two known children, Joel Halbert b. ca. 1712, who mar. Frances Jones, born, ca. 1708, Va., dau. [or widow] of John Jones and Frances Randolph (not a proven, or probable, descendant of Pocahontas as others have led people to believe), and William Halbert b. 1714-18, Essex Co., Va., and d. ca. 1760, Va..

Frances JONES was born in Virginia. She married Joel HALBERT Sr. in 1740 in Virginia.

They had the following children:

Notes

Joel Halbert was living in Caroline County, Virginia, on October 28, 1754, when he signed a joint bond with his brother William; he died about 1762, when the widow "Frances Halbert" was appointed administratrix of his estate in Caroline County. In 1764, according to a Caroline County record, she "qualified as guardian for the children". (The names of all the children are given in this record, though some were apparently of legal age by the year 1764.)

In colonial times in Virginia, a child was declared an "orphan" when the father died, but not when the mother died. A legal guardian was appointed by the Court for any child of age 14 or less; over 14, and until of legal age (21 for boys, 18 for girls) the child choose his own guardian.


1737 Will of Mary Taylor:

  • ITEM I give and bequeath unto my daughter Elisabeth Heeley my side sadle and one shilling sterling~
  • ITEM I give and bequeath unto my son William Halbert my gold ring ~
  • ITEM I give and bequeath unto my Grand Daughter Sarah Halbart my trunk
  • ITEM I give and bequeath unto my grandson Thomas Heeley five Shillings
  • ITEM I will, give and bequeath unto my Grand Daughter Molly Heeley five Shillings
  • ITEM I will, give and bequeath unto my two ~~~sons Joel Halbart and William Halbart (after my just debts paid funeral charges defraid and above legacies Satisfied and paid) All the remaining part of my estate to be Equally divided among them.
  • And I do appoint my said sons Joel Halbart and William Halbart Executors of this my Last will and Testament (carried forward)

Comments: Joel Halbert was not born in Wales. His wife “Elizabeth” was a widow Jones, and her name is seen as “Frances” on a land deed in 1747.
