Of the County of Franklin and State of Virginia of the one part and Josiah Woods and Robert Woods, Jr. of the County and state aforesaid of the other part. Whereas the said John Bird Sr. is justly indebted to a certain Joel Shrewsbury Co of the County and State aforesaid in the just and full sense of fifty six pounds eight shillings and one penny current money of Virginia due bond bearing, this day which the said John Bird Sr. is honestly desirious and willing more effectually to secure and aspire to the said Joel Shrewsbury Co. Now this indenture witnesseth that for and in consideration of the promisses and also one dollar to him the said John Bird in hand paid by the said Josiah Woods and Robert Woods, Jr., before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged the said John Bird Sr. hath given, granted, bargained and by these presents doth give grant bargain sell deliver unto them the said Josiah Woods and Robert Woods Jr. one certain tract or parcel of land containing one hundred and eight acres and bounded as follows on the waters of Chestnut Creek beginning on a red oak, S 23 E 41 po to pointers S 46 W 102 poles to a chestnut tree, S 51 W 152 poles -- a chestnut tree, N 61 W 44 poles to a red oak. Horses, Cattle, Sheep, Hogs, household and kitchen furniture consisting of bed, Pewter, etc. etc. etc. and quantity of Tobacco in parsels unknown unto them the said Josiah Woods and Robert Woods Jr. their heirs and assigns forever, and the said John Bird Sr. doth hereby further covenant and agree to and wit hthe said Josiah Woods and Robert Woods Jr., their heirs and asssigns against him the said John Bird Jr. and his heirs forever and all and every other persons or persons whomsoever shall and will forever defend the right and title of said land and premisses, horses, cattle, sheep, hogs, household and kitchen furniture consisting of Bed, pewter, etc. etc. also a quantity of Tobacco. In trust nevertheless that if it should so happen that the sand John Bird Jr. should fail or refuse to pay the said Joel Shrewsbury Co. the money to them before mentioned on or before the first of August next 1809, that then and in that case it shall be lawful to and for the said Josiah Woods and Robert Woods Senior , so soon as itshall be convenient to them or the said Joel Shrewsbury Co. shall require which ever of these two circumstances shall first happen and after having first previously advertised the day of sale for the space of twenty days by advertisement to be posted upon the front door of the Courthouse of Franklin County to proceed to sell on the premisses to the highest bidder for ready money by way of public auction. The aforesaid tracts of land, two horsese, hogs, seven head of cattle and increase, sheep, household and kitchen furniture, beds, pewter, etc. etc. and quantity of tobacco, and out of the proceeds arising from such sales to satisfy and discharge in first place the charges of drawing and recording this indenture and the incidental charges which shall attend to the conveying into full and complete effect the intentions of the parties as expressed by this indenture and in the second place to pay and satisfy to the said Joel Shrewsbury Co. whatever sum or sums of money shall then appear to be due to them and unpaid on my bond, and surplus if any there shall be to return to the said John Bird Jr., his heirs and the said John Bird Jr., doth hereby further convenant and agree to and with the said Josiah Woods and Robert Woods Jr. that upon a sale of the land, Horses, cattle, hogs, sheep, household and kitchen furniture, beds, pewter, etc. etc. and quantity of tobacco for the purposes aforesaid that the deed of them or either of them shall e sufficient to convey the said land and premisses, horses, cattle, sheep, hogs, household and kitchen furniture, beds, pewter, etc. etc. and quantity of tobacco as aforesaid, and will further for the purpose of quitting the possession and title of such person or persons as may become the purchaser or purchasers thereof execute to him or them respectively all such other deed or instrument of writing as shall by Council learned in the law be thought necessary and proper.
