Philip’s Will was probated 21-Mar-1786. (WB C, p 245, Culpeper Co Records) He was a Major in the Colonial Wars, as son of Samuel Clayton and Elizabeth Pendleton. His home in Culpeper Co was called “Catalpa.” Legend says his home was named for a species of tree Philip brought from Essex Co. (Slaughter’s History of St Mark’s Parish, Pt II, p 6) and (The Pendleton Family, by Mrs Katherine Cox Gattschalk, Washington DC, and Major John B C Nicklin, Chattanoogo, TN)

Catalpa was used as the first encampment for the Minute Men 1775

Ann Coleman was sister to Robert Coleman who owned the land Culpeper was built on in 1759 Called Fairfax before the civil war.

Samuel Clayton, of Abingdon Parish, Gloucester County, Virginia, married Susanna (surname unknown) and had issue: Samuel Clayton (1687-1735), of Essex County; married Elizabeth Pendleton, and had issue: Philip Clayton (born circa 1710; died 1785), of "Catalpa," Culpeper County; magistrate and militia officer; it was in the "old field" at his home that the Culpeper Minute Men organized in 1776; married Ann Coleman, and had issue: Lucy Clayton, married William Williams.

Comments:The place now owned by Mr. J. C. Bell was the seat of Major Philip Clayton , in colonial times, and was named from a catalpa tree (the first in the county), transplanted by him from Essex .

He married the sister of Robert Coleman , on whose land Culpeper was established in 1759 , and called Fairfax , which was its legal title before the Civil war.

The first trustees of the town were Nat. Pendleton , Wm. Green , Wm. Williams , Thomas Slaughter and Philip Clayton .

Ben Davis had leased the land from Coleman and hence the names Davis and Coleman streets.

One of the daughters of P. Clayton married Nat. Pendleton , whose son Nat. was a Minute Man of Culpeper , afterwards aid to Gen. Greene , and was the second of Alexander Hamilton in his duel with Aaron Burr . He was the ancestor of Geo. H. Pendleton , who was minister to Berlin .

His brother Henry was an eminent jurist in South Carolina , after whom the Pendleton District was called.

Another daughter of Clayton married Wm. Williams , the father of Gen. James , Maj. John , Philip and Wm. Clayton Williams , from whom a numerous progeny has descEnded.

Slaughter , who was born at Catalpa , Dec. 1758 .** He was living with his grandfather and going to school here to Adam Goodlet , master of the first classical school ever in Culpeper to that date, **when the Minute Men met in Clayton 's old field (Catalpa ) in 1775 **. Hence he had the best opportunity of knowing the facts recorded in his journal. ***The Minute Man, Gen. Stevens , who east the electoral vote of this district for Washington , also married the daughter of Robert Coleman .***

Eldest son of Samuel Clayton (1685-1735) and Elizabeth Pendleton, Philip, named after his Pendleton grandfather, was the very first so christened in the Clayton family.

He married Ann Coleman August 18th, 1736. They had children: Lucy who married William Williams; Samuel who on 12 Jul 1757, married his cousin Ann Coleman, daughter of Robert and Sarah Ann Saunders Coleman; and Susannah Clayton who married Col. James Slaughter in 1756.

Philip was a vestryman of St. Mark's Parish when Culpeper County was formed out of Orange.

He hosted the first encampment of the Culpeper Minutemen in 1775 on the old Clayton farm that came to be known as "Catalpa" for the huge flowering trees Philip had dragged across the countryside to plant there.

IN THE NAME OF GOD AMEN, I, Philip Clayton of St. Marks and Culpeper County Virginia being aged and infirm do make and order this my Last Will and Testament -
Imprimis I commend my soul to God who gave it in hopes of a Glorius Resurrection through the merits of my redeemer Jesus betrust my body to the Earth to be Interred at the Discretion of my Executors herein afternamed and as to what wordly goods it has pleased God to bestow on me (after Just Debts paid)

I give and bestow in manner Following VIZ.
Item I Give and bequeath to my Daughter Lucy Williams one negroe Girl named Milly to her and her heirs forever.
Item I Give and bequeath to my son Samuel Clayton all my lands and Tenements to him and his heirs forever.
Item I Give and bequeath to my loving wife Ann Clayton for and during her natural life all the remainder of my Estate of what kind so ever and after her Decease I Give the same to be Equally Divided among my three Children (to wit) Lucy Williams, Samuel Clayton & Susannah Slaughter to them and their heirs forever.
Lastly I do appoint my son Samuel, my son-in-law James Slaughter [p.246] and my grandson John Williams, Executors of this my last will hereby revoking all other Wills by me made and do ordain this and this only to be my Last Will and Testament.
IN WITNESS whereof I have hereunto set my Seal this day of 1779.

Exhibited to the Court by James Slaughter and Samuel Clayton two of the Executors therein named and was proved by the oaths of one witness and by consent of the children of the said Deceased. The said Will was Ordered to be Recorded and on the Motion of the Executors Certificate is granted them for attaining a probate thereof in due form they have made oath thereto & given Bond of Security according to Law. Security being reserved for the other Executor to Join in the probate when he may think fit
