About Mary Emery

Anastasia Martinez wrote,"My grandmother's family had their genealogy done professionally, some time ago and my father handed down the book. I have the book and could share pictures but I don't see a place to attach photos here. In it, the notes in this book for John Webster, born in Ipswich England and coming to Ipswich Massachusetts in 1637, it says he married an Agnes Shatswell and they had a daughter, Mary Webster who married John Emery. This profile on Geni shows the first name Mary for her instead of Agnes. Was Agnes a middle name? I see that it shows this "Mary" (which my record shows as "Agnes") also marrying a John Emery. It seems strange that both a mother and daughter would both marry a John Emery and because of this, it looks like it has raised confusion between the two Mary Emery/Webster profiles. However, according to what my grandma's records show, the woman who was born Shatwell and married John Webster was an Agnes Shatswell, not a Mary Shatswell. Does anyone else have any record of the name Agnes associated with the grandmother of Abigail Emery (Abigail Emery married Henry Ingalls)?"

Mary Shatswell was the sister of Margaret (Shatswell) Curwen, born about 1634 in Ipswich who married Matthias Curwen, as well as the sister of John and Theophilus Shatswell of Ipswich AN7. The will of her brother, “John Satchwell of Ipswich”, dated February 2, 1646 mentioned his son, Richard, his wife, Johan, his “brother & sisters’ children that are here in New England”, his brother, Theophilus Satchwell, his “brother Curwin”, and his “sister webster”, to whom he bequeathed “about seaven yards of stuff to make her a sute and alsoe a yonge heiffer thought to be wth calfe” TH26. The will of Theophelus Satswell of Haverhill, dated June 20, 1663, mentioned his wife, Susanah, his eldest daughter, Mary, his daughters, Lidea and Hannah, his brother, Wilyam Sargent, and his kinsman, Lieutenant Philip Challis TH26. The inventory of his estate was conducted on September 8, 1663 by John Emmerry, Sr. and John Eaton, Sr. TH26.
Mary Shatswell first married John Webster of Ipswich, Massachusetts EM1, CO1, SA11. John may have hailed from Ipswich in Suffolk, England, and in 1634 he was a freeman in Ipswich, Massachusetts SA11. Ipswich was formerly called Agawam SC4, SH17, and Captain John Smith referred to the location as “Agoan” and “Aggawom” CU7. John Webster was admitted as a freeman of Newbury on March 4, 1634/5 CU7, SA11, HO12. He may have been the John Webster who was granted four acres of meadow and marshland, north of the town of Ipswich, on January 5, 1635 SC4. He and Thomas Oddingsall were fined five shillings apiece on December 31, 1639, because they were supposed to appear as witnesses in a case regarding Micha Iver, but they did not appear at the Salem Court DO12. He may have been the “John Webster the Baker” who was admonished at the Salem Court on June 30, 1640 for “brewing and tipleinge” DO12, or put another way, for brewing and drinking beer. If John was a baker, he was directly affected by a law initiated on November 20, 1637, which stated that “no person shall sell any cakes or buns, either in the markets or victualling houses, or elsewheare, vpon paine of xs [ten shillings] fine; provided that this order shall not extend to such cakes as shalbee made for any buriall, or marriage, or such like speciall occation” SH17. John was involved in several court cases at Salem in the years 1641 and 1642 DO12. He was the plaintiff against William Barber on June 29, 1641, the defendant against William Pester in a civil case regarding a debt on January 25, 1641, and the plaintiff in a defamation suit against William Pester and Charles Turner on that same day DO12. He served as a juror at the Ipswich Court on March 29, 1642, and when he appeared at the Salem Court on July 12, 1642, he was the plaintiff in a debt case against Edward Payne, as well as the defendant in another debt case against William Browne DO12. John’s death occurred sometime before September 29, 1646, when Mary Webster was appointed the administratrix of his estate DO12. With John Webster, Mary was the mother of John SA11, SH18, HO12, Mary, Stephen, Hannah, Elisabeth, Abigail, Israell, and Nathan Webster SA11, SH18, HO12.
John Webster was probably born in England in about 1632 or 1633 SA11, as he stated that he was forty-seven in a deposition dated on March 30, 1680 CU8. At a General Court Session on November 4, 1646, the court heard the petition of Mary, the widow of John Webster, that when her eldest son, John Webster, reached the age of twenty-one, he should have the thirty-two-acre farm which was situated between Mr. Roger’s oxen pasture and Thomas Bishop’s farm SH18. John would be obligated to pay Nathan, called the youngest child, five pounds when Nathan reached fourteen years, or if John refused to pay five pounds then he was obligated to pay one quarter of what the land was then worth SH18:

Mary Webster, the wife of John, was mentioned in the will of her brother, John “Satchwell” of Ipswich TH26, DA13, SA11, who had arrived in Ipswich sometime before September 3, 1633 DA13. His will, dated February 2, 1646/7 and proved on March 30, 1647, also named his brothers, Theophilus Satchwell and Curwin TH26, DA13, SA11. John made a bequest “To my sister webster about seaven yards of stuff to make her a sute and alsoe a yonge heiffer thought to be wth calfe” TH26.
She and John “Emmary, sr.” were deposed at the Ipswich Court on March 25, 1651 pertaining to William Randall and his wife, Elizabeth, who had been presented to the court on October 10, 1650 “for suspicion of fornication”, because Elizabeth had given birth nine or ten weeks before her anticipated due date DO12. John Emery, Jr. and his wife were witnesses in this case, but the deposition was given by John “Emmary, sr. and his wife”, who stated that William Randall married Elizabeth “a fortnight and a day or two after myallscit”, or Michaelmas DO12, which indicates that their wedding was approximately October 14. John and Mary said that Elizabeth Randall went into labor on May 14, 1650, and after her child was born, Elizabeth sent for Mary DO12. Mary Emery swore that “William Rendale denied that the child was his as it came before her time”, and further said that “from six or seven weeks before marriage he would own the child to be his” DO12.
On October 14, 1651, the General Court granted John Emery the power to sell “a certayne iland which was left to three of his wiues children; & also a howse & six acors of land”, on the condition that he gave security to the Ipswich County Court to pay the children the entire selling price of the land, and “make the three childrens twenty nobles a peece eight pounds a peece” SH19. At the Salem Court on November 25, 1662, Israell and Nathan Webster, who were eighteen and sixteen (and so born in about 1644 and 1646, respectively), requested that his father-in-law (stepfather), John “Emory”, and his brother-in-law (stepbrother), John “Emory”, Jr., be appointed as their guardians, which the court authorized DO14.
A court case which was withdrawn from the Ipswich Court on March 25, 1662 indicated that John and Mary Emery, the plaintiffs, had alleged that James Merrick had detained and held Issraell Webster, Mary’s son, without the consent of John or Mary Emery DO13. Related to the case of Henry Greenland, “Hana Noic” (Hannah Noyes) testified at the Ipswich Court on March 31, 1663 that “Goody Emerie accused her daughter, Betie Webster, of taking a false oath before the magistrate and Betie answered that she had said nothing but what she would stand to. Then her mother told her she lied and had taken her oath to a paper that she had heard read but once” DO14. At the Ipswich Court on May 5, 1663, Elizabeth Webster was accused of taking a false oath in court, and she was ordered to stand at the door to the Newbury Meeting House the following lecture day (probably Sunday) with a paper attached to her head, with the phrase “for taking a false oath in court” written in captital letters, from the time the first bell rang, until the preacher was about to pray DO14, CU7. Her alternative was to remit a fine of five pounds in addition to the court costs and fees, and she would have been disabled from taking an oath, but Elizabeth opted to stand at the door as her punishment DO14, CU7.
Mary created her will on April 1, 1693 (or August 1, 1693 AN7), which was witnessed by James Gulmar and Elizabeth Briket, and was proved on November 11, 1696 DA15, HO12 (or June 1, 1696 AN7). Her will was written by two different people AM1. The first section was scripted by an individual with fairly even penmanship, who had a good grasp of grammar and spelling, while the remainder, which contained the most important details, was scrawled haphazardly across the page. It resembled the awkward jottings of an inebriated landlubber on his first sailing expedition across the Bermuda Triangle. It began AM1:

In the name of God Amen I. Mary Emery of newbury in the County of Essex in the province of the Massachusetts Bay in new England, (Widow & Relict of John Emery Late of newbury deceased) Being weake of Body but of a desposet [the last one of two letters of this word were illegible, but somewhat resembled “et”] mind Do make this as my Last will & testament as followith viz Imprm[is] I give…
To her son, Jonathan, she bequeathed the entirety of the ten pounds which her husband had bequeathed to her, and she forgave his debt of thirty shillings which he owed to her DA15, HO12. She gave twenty shillings to her four granddaughters, who were the daughters of her son, Israell Webster, and ten shillings to John Webster’s son, Isrell HO12, AN7. To her “Daughtr Simon” HO12 (or “Semns” AM1) she bequeathed her serge gown and to “Abigell Mrell” she gave what may be deciphered as a white handkerchief; these individuals were her daughters Elisabeth, who married Samuel Simonds, and Abigail, who married Abraham Merrill HO12. She gave a black silk hood to “Johanna Mythe” (Joanna Matthews, Mathies, or Mathew) who was Mary’s great-granddaughter; Mary’s daughter, Hannah, married Michael Emerson, and their daughter, Mary Emerson, married Hugh Mathew, and their daughter was Joanna Mathew, who was not quite three at the time of Mary (Shatswell) (Webster) Emery’s will HO12. Mary left the remainder of her apparel to her daughter, Ebenezer DA15, HO12. Her will may have indicated that she desired her son, Steven Webster, to pay twenty shillings apiece to “Hanah Emeson” (this may have stated “Marah”, rather than “Hanah”) and Abigell Merrill, and the balance of her estate was willed to Steven Webster HO12.
