Wills: Mary Kendrick Fox 1795. Mecklenburg County Virginia
Submitted by Peggy Wallace 9 Feb 2000
In the name of God Amen, I Mary Fox of Mecklenburg County, Virginia do appoint and ordain this writing to be my last will and testament revoking all others heretofore made.
Imprimus: I give to my son Henry Fox and to his heirs forever all that tract of land I bought of Benjamin Pennington except a corner which runs into the tract I now live on supposed to be five acres laid off by a marked line which I desire may be sold with my husbands land and the money be divided as is directed by his will.
Now the above legacy to my son Henry is considered and intended by me as full discharge of any and all dues and debts I do now owe him upon hand or other ways and if he should fail to grant immediate and sufficient discharges I will and desire that so much of the land given to him as will answer the purpose may be sold to pay any claim he may bring against my estate.
Item: I give to my daughter Mary Kendrick Fox and her heirs forever 1 Negro girl named Aggy.
Item: I lend in trust to my son Henry For for the use of my daughter Sally Jones Nowell and to no other purpose whatsoever so long as she shall live a Negro boy named Nicholas and at her death I give the said Nicholas to her son William and if William should die before his mother I desire the said Nicholas may be sold and the money equally divided among my surviving children of my said daughter.
Item: I give to my daughter Joe-Hannah Fox and to her heirs forever a Negro girl named Fanny Bailey and a saddle and bridle.
Item: I give to my daughter Priscilla Fox and her heirs forever a Negro girl named Courtney Bailey, a mare called Spinnett and a saddle and bridle.
Item: I give to my daughter Betsey Fox and to her heirs forever one Negro boy named Burwell and a woman named Doll [but none of her future increase] and my saddle and bridle.
Item: I give to my grandson Arthur Fox and to his heirs forever a Negro boy named Randolph.
Item: I will and desire that the future increase of my Negro woman Doll be equally divided amongst my daughters Mary Kindrick Fox, Joe-Hannah Fox, Priscilla Fox and Betsey Fox, notwithstanding the above restriction in respect to the future increase of Doll I still intend her certain proportion agreeable to this clause.
Item: My will and desire is that my Negro boy Robin be sold to the highest bidder upon twelve months credit and out of the money arising from this sale I give to my daughters Joe-Hannah and Betsey twelve pounds each.
Lastly I appoint my son Henry Fox, Richard Fox, William Davis, James Harwell and John Davis Jr., Executors of this my last will and testament in Witness whereof I have hereunto set my hand and affixed my seal this 9th day of October 1795.
