About Mary ‘Elizabeth’ Harris

Not a proven child of Col. William Claiborne. Evidence needed to support as wife of Edward Rice of Virginia

"There is no primary source that identifies Mary Rice as a Claiborne or the daughter of William Claiborne. She should not be included in a list of his children...."

Mary

  • Birth: 1630 - Elizabeth City, King William, Virginia, USA
  • Death: Feb 9 1710 - Glen Cairn, Doswell, VA, British Colonies
  • Husband: Robert Harris

Known children of Robert and Mary include:

  1. Mary Harris (born c. 1662) - married Joseph Royall
  2. Judith Harris (born c. 1664)
  3. Thomas Harris (c. 1666 – c. 1725) - married Mary Giles
  4. William Harris - married Temprance Overton

There have been numerous, numerous claims about the issue of Robert Harris and Mary Claiborne, most of which have unsubstantiated. The issue listed above are those who are the most certain.

William (married to Temperance Overton), has been genetically linked to Robert Harris. There is no debate there. Claiborn Harris, Robert's grandson, has been genetically linked as well. Those who are interested are recommended to check out the Harris DNA project for more information.

Note: In a footnote, Dorman says "no record evidence has been found to support" a daughter of William Claiborne who married ___ Rice and Robert Harris

No family Bible record is known to exist and the will of Capt. William Harris was lost in the fire which destroyed the Hanover County records. The following list of children of Capt. William Harris has been derived from both court and family records:

  • (1) Major Robert Harris of Albemarle County
  • (2) Benjamin Harris of Hanover County
  • (3) William Harris, Junior, of St. Paul's Parish
  • (4) John Harris of Hanover County
  • (5) James Harris of Hanover County
  • (6) Jemima Harris who married her cousin William Overton.

Now, despite it not being my line and really none of my business, I'm still going to say it:

THERE IS NO MARY CLAIBORNE WHO WAS A DAUGHTER OF WILLIAM CLAIBORNE!

WILLIAM CLAIBORNE HAD NO SECOND DAUGHTER NAMED MARY!

ROBERT HARRIS OF NEW KENT IN 1662 WAS NOT MARRIED TO ANYONE NAMED MARY CLAIBORNE RICE!

If there ever was a Mary Claiborne who married a Robert Harris, it occurred two or three generations later much farther west in Virginia. If there was a Mary Claiborne then, she would have been a great granddaughter or later to William Claiborne, definitely not a daughter.

Malcolm Hart Harris is generally credited with being the source of the Mary Claiborne myth, but as Mr. Wallace indicates in his post, Malcolm Hart Harris only made a very slim case that Robert Harris MIGHT have been married to a daughter of William Claiborne. Harris researchers ever since have taken that and made a whole lot more of it than Malcolm Hart Harris ever intended

Disputed Origins

From the profile for Robert Harris:

Major Robert Harris, of "The Forks"

Possible Marriage

The conclusion of several researchers of the Harris family is that Robert Harris of Wales (1630-1700), about 1650, married the widowed Mrs. Mary Rice, whose maiden name was Claiborne. She, reportedly the widow of one Edward Rice, was the daughter of Secretary William Claiborne and his wife Elizabeth Butler. These same researchers have concluded that Robert and Mary's son, William, born in 1665, married Temperance Overton (b. 1679), daughter of William Overton.

However, Dr. Harris has written, "It seems more probable that Robert Harris did marry Mary Rice, widow of Edward Rice and daughter of Col. William Claiborne and Elizabeth Butler his wife, but there is no record left to prove it, as far as known [parts of sentence are italicized], for records have been destroyed." In a later publication concerning the Claiborne family, John Frederick Dorman writes in a footnote that there is no evidence of a such a marriage.

Davis also cautions that there is no definitive answer concerning the wife of Robert Harris. Neither does there seem to be evidence of the name of the wife of Edward Rice. There is no documentation that Robert Harris married Mary (Claiborne) Rice, widow, nor is there documentation that William Harris was the son of Robert Harris, "the immigrant. "

Davis points out that the land holdings of both Robert Harris and William Overton were in Blisland Parish, New Kent Co., not too far from the plantation where Colonel William Claiborne had established his home, after he left Kent Island in the Chesapeake Bay.

disputed ancestry

There has been much speculation about "Mary" Elizabeth Claiborne. Some researchers claim she never exists, some claim she is not a daughter of William Claiborne, others claim she was never married to Robert Harris, while finally others claim she was not married to "our" Robert Harris.

  • The basic premise is that Mary (Elizabeth) Claiborne was the daughter of William Claiborne, and that she was married for a short time to Edward Rice. After Rice's premature death, Mary went on to marry Robert Harris.

From http://www.genealogy.com/forum/surnames/topics/whitworth/1090/

The Mary CLAIBORNE who m. (1) Robert HARRIS was b.abt. 1630, since she bore her first child in 1652.She later m. (2) Edward RICE, and she had one son by each husband to whom she gave the name "Claiborne," a sure sign of this lineage. This Mary CLAIBORNE can only be the dau. of Hon. William CLAIBORNE 1st and wife Elizabeth BUTLER, who were having their children in the 1630s and 1640s -- there were no other CLAIBORNE families in New Kent or the Pamunkey Neck at this date.THIS MARY IS TO OLD TO BE THE WIFE OF JOHN WHITWORTH.

Dubious notes

Some of the following information seems helpful, but other aspects seem questionable, such as the "Albermarle, King William Co, VA" (which is not a place, so I've deleted them here) and the listing of Rice children and their dates, about which I'm quite skeptical. If she married Harris AFTER being married to Rice, and her first Harris child was born when she was age 19 in 1849, then giving birth to 13 Rice children would have been impossible. However, the dates of the Harris children are reasonable.

Fr Bill Deyo I have had a number of e-mail with J. Phil Harris about Elizabeth Mary Claiborne. I showed him where he had many holes in his thinking. I cannot understand why many are so adamant about not wanting Robert Harris to have married Mary Claiborne, when they admit Robert Harris' father was a surveryor "partner" of William Claiborne. Your referenced note of his stated that Claiborne only had a daughter, Jane, but there is proof that he also had a daughter, Elizabeth! Elizabeth's patent is in walking distance from Robert Harris' land! There are many other connections as well. There is no documented record of "Mary" Claiborne because her given/legal name was Elizabeth. Mary was simply her religious confirmation name that she preferred to be called by. This is the exact case of William Harris' mother-in-law, Elizabeth "Mary" (Waters) Overton, and was not uncommon. I have a Catholic friend who assures me that it is still a common practice for people to use their confirmation name among friends, but their given/legal name must be the one recorded on legal documents. In the 1600s not only the Catholic Church, but also the Anglican Church, kept the practice of confirmation names. After all of my e's with Phil Harris, he stated that he had no problem in Robert Harris marrying Elizabeth Claiborne!! I was glad to see the current DNA references. I had checked on this a few months ago when there were no participants from the William Harris/Temperance Overton line.

DNA would solve the mystery of whether the husband of Mary Giles came from the Capt. Thomas Harris line or the Robert Harris/Mary Claiborne line. The tradition is the latter and was even spelled out in an old Harris diary, but it is no longer available.

notes

There is no primary source that identifies Mary Rice as a Claiborne or the daughter of William Claiborne. She should not be included in a list of his children. The connection is wholly through supposition by use the Claiborne name in the Rice family.

Edward Rice married Mary Elizabeth Claiborne, born ca. 1635, when she was a teenager, after 1650. They had 3 sons: James, John/Claiborne and Thomas. Edward died in 1660, leaving Mary with at least 2 babies to raise alone (the 3rd likely died as an infant). As was often the case, young Mary married a local widower, also with young children, Robert Harris, in 1661. Robert, son of Thomas Harris and Adria (Osborne) Harris, had been born in England in 1615 and left behind when his parents emigrated to Virginia in 1619. Raised in England, he sailed for Virginia in 1650 with his own family. His wife (Names: Unknown) died around 1660, leaving him with several young children. Robert and Mary had one son together: William Harris, who married Temperance Overton in 1697.
