About Meletiah Nye

In the Name of God Amen this Twentieth Day of October Anno Domini 1748 I Mellatiah Nye of Falmouth in ye County of Barnstable in the Province of Massachusetts Bay in New England yeo'n do make and Ordain this my last will and Testament.

Imprimis. I Give my Soul to God that Gave it and my body to the Ground to be buried at the Discretion of my Executor hereafter named and as Touching Such worldly Estate as it hath pleased God to bless me I Give and Dispose of the same in the following manner & form first I Give to my Dearly beloved wife Jemimah all the moveables she brought with hir at marrage the same to be hirs forever also I give hir the use and Improvement of one fire room in my Dwelling house During her being my widdow and if I shall build another Room in my Life time she may have the choise of that for hir convenience Instead of what I now have in being also I give her one Cow to be kept winter and summer by my son Shuball During hir being my widdow also she shall have the Liberty of using part of my Sellar & well for water also my will is that she be well and comfortably supported both in health and sickness with all things needful by my son Shuball or his heirs and in case he or his heirs &c shall refuse and neglect to provide for hir as above said and she shall chuse It then I Give her eight Bushels of Indian Corn one bushel of Rye and one bushell of wheat a year During Each year she shall live my widdow also fore score of pork and three score of beef both well fed ten pounds of Sheeps wool and six pound of flax a year and hir firewood Cut fit for the fire at the Doar and two gallons of molasses a year yearly so long as she shall continue my widdow also my will is that she shall have an horse found for hir to ride as she shall need.

Item. I give to my son Malletiah the house he now Lives in & Land which he now Improves which I bought of Hanable Handy in Sandwich Reference being had to the Deed I hold by for the Contents and bounds thereof as also the wood lot of Land I bought of Nathaniel Wing of Sandwich and also that Piece of salt marsh I have in Falmouth Lying by Conyhues harber a Place so called on the other side the neck all said Lands and housing to be to him and his heirs and assigns forever he Paying out such Leagacies as I shall order.

Item. I Give to my son Solomon besides the Provision that is or may be made for him twenty five shillings in bills of Publick Credit of the last Emission and that to be his part of my Estate.

Item. I Give to my son Shuball whom I appoint and Ordain Sole Executor of this my last will and Testament all my Real Estate of all sorts whatsoever wherever the same is or may be found and the same to be to him and his heirs and assigns forever Excepting what I have in this my Will Otherwise Disposed of And I Give it upon Condition he fullfill these Articles following viz. that he pay my Just Debts and funeral charges and do support my wife during hir being my widow as above Expressed as she shall chuse and Quist hir in the Improvement of one fire room in my Dwelling house and do all other things allotted for hir in this my will and also that he support his Infirm brother Silvanus During his Impotency and pay his brother Silvanus twenty five pounds new Tennor bills of the last Emission one quarter part thereofwithin one year after my Decease and the quarter part more at two years End and the third Quarter at three years end and the fourth and last Quarter part of said twenty five pounds at four years end after my Decease & also that he pay the Legacy Given to his brother Solomon in this my will being twenty five shillings new Tennor within one year after my Death also I give my said son Shuball all my out Doars moveable or Personal Estate out of the house not any within Doars.

Item. I Give to my two Daughters all the Indoors Moveables after my wife has taken out what I have Given her that shall be left the same to be Equally Divided between them or their heirs also I Give to my Daughter Mary twelve pounds ten shillings new Tennor in bills of the last Emission to be paid hir by hir brother Malletiah within one year after my Decease also I Give to my Daughter Sarah fifteen Pounds new Tennor bills of the Last Emission to be paid hir within one year after my Death by hir brother Mallatiah or his heirs.

Lastly I do hereby Revoke all former will or wills by me made and rattifye and confirm this as my last will and Testament in witness whereof I the said Mallatiah Nye have hereunto set my hand and seal the day and year first above written.
