Owen Sullivant, ll, of Charlotte County

1. Owen Sullivant II was born abt 1699 / November 5, 1709 in Princess Anne Co., VA, and died abt Feb 1769 / 1790 in Charlotte Co., VA. He was the son of 2. Owen SULLIVANT.

It is unclear whether his mother was Ruth (Pleasant?) or Elizabeth Claiborne.

He married Margaret HEWLETT May 1721 in Caroline Co. area, VA, daughter of William HUGHLETT HEWLETT and Mary Margaret FEARNE. She was born 4 Mar 1707 in Northumberland Co., VA, and died aft 6 Feb 1769 in Charlotte Co., VA.

After marriage, moved to Lunenberg County, later Charlotte County, Virginia, settling on Twitty's Creek.

March 4, 1707, Virginia, (daughter of WILLIAM HEWLETT and MARY FEARNE) d. Virginia, buried Virginia. OWEN died 1790, Charlotte Co., Virginia, buried Charlotte Co., Virginia.

OWEN II is named in his father's will. By deed Oct 1, 1781, OWEN SULLIVAN conveys to Chas. Crenshaw 151 acres "including the late dwelling house of the late OWEN SULLIVAN deceased, devised to said OWEN SULLIVAN by Will of OWEN SULLIVAN deceased (Charlotte Co., Virginia D Bk 3, p. 571). There are records of other sales from OWEN SULLIVAN to James Mullins, Stephen Farmer, etc. A HISTORY OF THE SULLIVAN FAMILY was compiled 1882 and published by William D. Sullivan 1913. In it he states OWEN & MARGARET had 5 children to move from Virginia to S. Carolina. MARY FEARNE was the daughter of JOHN FEARNE and MARY LEE.

Have in my possession a transcribed copy of 6 Feb 1769 proven will. Note the following information that is important to determine which Owen Sullivant we are speaking of:

"I, Owen Sullivant of Charlotte County. . .son, Charles. . .son, William. . .James Mullins, my son in law. . .son, Pleasant. . .two daughters namely Margaret Modelin. . .daughter Patience. . .son Owen. . .five daughters: Patience, Frances, Margaret, Modelin and Elizabeth sixty acres of land lying on Twitty's Creek. . .during life if not married but as soon as married to remove and have no claim to said land. . .my seven children namely: Patience, Frances, Margaret, Modelin, Owen, Elizabeth & Pleasant. . .my two daughters Temporance Farmer and Esther Hart. . .son William. . .son in law James Mullins my executors. . .will exhibited by William Sullivant and James Mullins." -- Estate document dated 12 Oct 1769 (Charlotte Co., Will Book 3, p 260)

Owen Sullivant having obtained an attachment against the estate of Edmund Gray (who is said to be run away or so abscond (sic) that the Ordinary process of Law cannot be served on him.) for the sum of 4/4 current money & the Sheriff of this county having made return that by virtue of the said attachment he hath levied the same in the hands of Charles Talbot, who he had summoned to appear as a garnishee of the said Gray. This day came the said Owen by his attorney for the said Gray not appearing to reply the attached effects, the said Talbot appeared and on oath saith that at the time of Levying the said attachment he had in his hands of the estate of the said Gray more money that will satisfie the said sum of 4/4 of the said Owen's demand appearing to be just therefore it is considered by the court that the said complainant recover against the said Gray his said debt aforesaid together with his costs by them about his Writ in this behalf expended, and that the said Owen have execution against the said Charles for the said Sum of 4/4 current to discharge this judgment.

(Patent Book No 32, folio 631) and a patent was issued to JOHN SULLIVAN for 400 acres on both sides of Stith's Branch in Lunenburg County, VA on August 15, 1764 (Patent Book 36, folio 656)

In Burnswick County Poll List 1748 for those voting for the Representative in the House of Burgesses that year is JOHN SULLIVANT. After 1774 a JOHN SULLIVAN received a land bounty in Halifax County, VA. OWEN O'SULLIVAN I was granted 240 acres Nov. 7, 1700 at Dam Neck, near OWEN HAYES at Fish Pond (Princess Anne Co., Virginia, Bk 4 folk 126). Also granted 862 acres Sep 10, 1755. The tithable List of William Caldwell, taken 1749 for Lunenburg, shows OWEN SULLIVAN (William & Mary Quarterly, 11/57).

This Indenture this 1st day of October 1781, between Owen Sullivant of Charlotte county and Charles Crenshaw, of Hanover County, for the sum of 200 pounds, specie, (conveys) a certain parcel of land containing 151 acres, bounded by the lines of Dudley Brooke, (formerly Charles Sullivant's), the late Isaac Read Esq., James Hamblet and Twitty's Creek, including the late dwelling house of Owen Sullivant, dec'd. Signed Owin Sullivant. Margaret, wife of the said Owin Sullivant, being first privily examined etc.

A History Of The Sullivan Family was compiled 1882 and published by William D. Sullivan 1913. In it he states: Owen & Margaret had 5 children to move from Virginia to South Carolina.

IN THE NAME OF GOD, AMEN. I, OWEN SULLIVANT of Charlotte County of sound and perfect mind and memory do make covenant and appoint my last will and testament as follows, to wit:

My death and funeral expenses being first paid, I give and devise to my son, CHARLES SWILLIVANT two hundred acres of land whereon he now lives on the lower end of my old patent land beginning at an Elm at the mouth of Miherrin running a straight line to the head of the Fish-trap Branch thence down to the back line to him his heirs and assignees forever also the use of a ____ and ten acres of land over the said line to him during his abode at the plantation living.

I give and devise to my son, WILLIAM two hundred acres of land on East Side of Twittys Creek at the upper end of my survey where he now lives to him and his heirs and assignees forever.

I give and devise to JAMES MULLINS, my son in law [sic: Brother in law?] one hundred acres of land the said tract of land containing the plantation whereon he now lives during his wifes life and continues on the said land so long and that he shall have no enter on the said land as long as he desires to stay thereon but after his wifes life or their removal from the said land, I give and devise the said one hundred acres of land with all the remainder of my said tract on East Side of the aforesaid Creek containing one hundred acres more to son, PLEASANT, to him his heirs and assignees forever.

I give and devise my beloved wife the third part of the remaind of my land on the west of Twitty's Creek of my land whereon I now live with the plantation & also during her natural life; I give and devise my said wife the third part of all my moveable estate of what kind or quality sound except two mares the one branded on the rear buttock thus O. S. the other a young mare called Fanny to her during her natural during her natural life.

I give and devise to my two daughters namely MARGARET & MODELIN each of them one of the two first colts that shall be raised from the aforesaid mare branded on the Rear buttocks to them their heirs and assignees forever.

I give and devise unto my daughter PATIENCE the within mentioned young mare called Fanny reserving the two colts aforesaid.

I give and devise to my son OWEN the within mentioned mare branded on the rear buttocks as aforesaid O. S. reserving the two colts aforesaid.

I give and devise to my five daughters: PATIENCE, FRANCES, MARGARET, MODELIN and ELIZABETH sixty acres of land lying on Twitty's Creek part of the said tract whereon I now live with a plantation thereon and an apple orchard to them during life if not married but as soon as married to remove and have no claim to the said lane.

I give and devise to my son, OWEN all the remainder of the said tract of land whereon I now live to him his heirs and assignees forever.

I likewise give and devise to my said son, OEN, the plantation and the third part of my said land which I have bequeathed unto my aforesaid wife after her decease to him his heirs and assignees forever and the aforesaid sixty acres and plantation after all my aforesaid daughters deaths or marriages (which shall first happen) to his his heirs and assignees forever.

I give and devise to my seven children namely: PATIENCE, FRANCES, MARGARET, MODELIN, OWEN, ELIZABETH & PLEASANT all the rest of my moveable estate (except my aforesaid wife's part &c) to be equally divided among them to them their heirs and assignees.forever.

I give and devise to my two daughters: TEMPORANCE FARMER and ESTHER HART. Each of them one shilling & three pence ... besides what they have already their portions I do constitute and appoint my son, WILLIAM SWILLIVANT and my son in law, JAMES MULLINS my executors of this my last will & testament.

IN WITNESS whereof I have hereunto set my hand and affixed my seal this twelfth day of October one thousand seven hundred and sixty eight.

Subscribed and ___ to be ____ on the motion of the said executors who made oath according to law. Certificate is granted them for obtaining a probate of the said will in due form where upon they together with SAMUEL PERRIN & Charles Swillivant their securitys __ into & acknowledged their bond according to law for that purpose.
