About Captain Samuel Avery, III

"Samuel Avery, youngest son of Capt. James, was a large farmer, and most of his life a magistrate. He like his brothers, was a captain of a train band, on the East side of the rive r, for considerable time, and the military spirit that he inherited from his father has descended to the present generation. The foregoing pages will amply prove that 'blood will tell,' and in every branch of the great family. He was a public man from the beginning; he was chosen moderator upon the legal organization of the town of Groton, in 1704, and its first townsman, at the first town meeting, in 1705, and held office till his death, May 1, 1723.

Hill's Tract, of several hundred acres, was conveyed to him by Uncas, in exchange for Betty, an Indian woman, taken captive in Philip's war, and given to James Avery, who sold her to Charles Hill in 1678. His farm was in what is now called South Groton, and I have been informed that some parts of it are still in the hands of, and still cultivated by, some of his descendants. His descendants are not so very numerous; his first and third sons died very young, and the second, only left two, of whom we have any trace, and the others, Nathan and Waitstill, but one. The fashion of naming the sons from members of the family, is shown in this family in a marked degree.

The first was named for his father, Samuel, jr.; the second for his uncle, Johathan, his mother;s brother; the third for his grandfather, William; the fourth for the father's grandfather, Christopher; the fifth for the mother's grandfather, Humphrey; the sixth I have no clue; the seventh for the governor, John; and the eighth for a brother of the governor, and perhaps a cousin of the mother, Waitstill. Samuel died the youngest of the four brothers, and is buried about a mile northwest of Seth Williams' farm, in Ledyard, on the farm of C. H. Stanton."


John Avery and Abigail Cheseborough (Cheesboro). John Avery was the third son and fifth child of James Avery, Sr. John Avery was an extensive land owner, holding , in addition to the place upon which he lived, land in several other towns. For his services in the Narragansett War, he received lots in Volutown, No. 9 for arable land and No. 76 for cedar swamp. John Avery married Abigail Cheseborough on November 29, 1675. Abigail was the daughter of Samuel Cheseborough (bpt. 1627-1673) and Abigail Ingraham.


Mr. Samuel Avery, the first townsman, was also a man of note. Youngest son of James Avery, one of the early settlers, he served the town from his election in 1705 until his death May 1, 1723. He owned a large farm in Groton, was captain of a train band and was in public service during most of his life.

We are not able to give the date of his death, but he deeded land to his son Nathaniel, April 17, 1724.
John-3 Avery was an extensive land owner, holding, in addition to the place upon which he lived, land in several other towns. February 16, 1688, Capt. James-2 Avery, "out of love," gave to his son, John-3, the land that he had bought of Thomas Hungerford at the head of "poqeuannock plaine," also land that was originally Joacb Waterhouse's also a parcel of meadow on a brook commonly called Stony Brook: and "all that meadow each side that I bought of William Meader." (New London Deads.)
John-3 became a freeman of New London, May 12, 1681. His name appears on the patent for New London, Oct. 14, 1704. In the list of the inhabitants of Groton in 1708 and 1712 are found the names of Capt. John-3 Avery and his son, John Avery.
Capt. John-3 was townsman of Groton, 1706. He was chosen with his brother, James, member of a committee to lay out 100 acres of land to Mr. Woodbridge, July 15, 1708. He was a member of the church of Groton, Nov. 22, 1727, as his wife is not mentioned, it probable that she was then dead.
The general court record, May 13, 1697, we learn that "John Aurey (was) appointed Captian of the train band at New London on the east side of the riuer." (Conn. Col. Rec., 4:212.)

1. July 7, 1691 John, of New London, sold land in Stonington to Daniel Shaw. In 1692 and 1693 John was appointed Ensign "on the east side of the river at New London". In 1697 John was appointed "Captain of the train band at New London on the east side of the river". In 1700 he became one of the original proprietors of New Lebanon (now Lebanon). In 1704 his name appears with this title in the patent for New London, granted by the General Court October 14, 1704 and as late as May 1705 the General Court confirmed him in the possession of lands in that town. He then owned land in Preston in 1706. In 1708 and 1712 records indicate that he lived in Groton with his son John, Jr. May 11, 1709 John and Abigail (Chesebrough), his wife, sold land in Stonington to John Benit. The land had belonged to Abigail's father Samuel Chesebrough. On January 5, 1713-14 "Abigail Cheseboro, relicit of Samuel cheseboro, but now Abigail Avery, makes deposition that Samuel Cheseboro, deceased, did intend to give certain alnd to my daughter, Abigail cheseboro, now Abigail Avery."

John Avery, born 10 February 1654. He married Abigail Cheseborough, 29 November 1675. The marriage was recorded at both Stonington and New London, Connecticut. On 7 July 1691, John and Abigail Avery, of New London, sold land to Daniel Shaw. (See Stonington Book of Deeds, Vol. 1, p161).

At the General Court in Hartford, 12 May 1692, it was recorded:

“This Court doe not see reason to confirm those nominated for officers on the east side of the river at New London at present, but doe appoynt Captain James Auery to be Captn of sayd Company, and James Morgan Lnt, and John Auery to be Ensign of sayd company untill the honoured Major Generall and Mr. Witherell shall see cause to lead them to a new choys of officers.” (See colonial Records of Connecticut for 1692, p74).

The record of the General Court for May 11 of the following year, has this:

“Thomas Auery is approued to be Captn of the traine band of New London on the east side of the riuer, and John Morgan Lnt, and John Auery, Ensigne, of sayd Company and are to be commissionated accordingly."

From a similar record of the General court, 13 May 1697, we learn that, “John Auery [was] appointed Captain of the train band at New London on the east side of the river.” His name appears with this title in the patent for New London, granted by the General Court, 14 October 1704. In 1700, he became one of the original proprietors of New Lebanon, and, on 10 May 1705, the General Court confirmed him and his associates in the possession of lands in that town. He is known to have held lands in Preston, Connecticut, in 1706.

In 1707, Capt. John Avery and John Avery, Jr., were inhabitants of Groton. On 11 May 1709, John Avery and Abigail, his wife, sold land in Stonington to John Benit. (Stonington Book of Deeds, Vol. 1, p436.) The land had formerly belonged to Samuel Cheseborough, father of Abigail. In 1710, Captain John Avery bought land from John Plume for twenty-eight pounds in Preston Farms, and also from John Morgan for eight pounds in hand and eleven pounds well secured. (See Preston Town Records.)

In the list of “Inhabitants of Groton in 1712,” are found the names of Captain John Avery and John Avery, Jr. In the list of the early members of the First Congregational Church of Groton, is found the name of Captain John Avery. On 5 January 1713/1714, Abigail Cheeseborough, relicit of Samuel Cheseborough, and then Abigail Avery, made deposition that Samuel Cheseborough, deceased, did intend to give certain land “to my daughter, Abigail Cheseboro, now Abigail Avery.” This is the last record found concerning John and Abigail Avery.

Investigation shows that the John mentioned by Mr. Sweet belongs to the line known as the Thomas Avery line of Portsmouth, N. H.(see p. 24), and that he and all of his descendants must be transferred to that clan.On the basis of this information, as well as the same error captured by other editors of the [Avery-32] profile, it has herewith been detached from these parents.[JRF]
