Anthony Winston, great-great-great-grandfather of Mr. Goldsby, was a delegate from Buckingham county, Va., to the Virginia convention of 1775, which voted to arm the colony, etc., and served as a captain in the Revolutionary army. Four of his sons and two of his sons-in-law served in the Creek Indian war under Gen. Andrew Jackson. They raised the company of rangers of which John J. Winston was captain, Anthony Winston was lieutenant and John Pettus (father of Senator Edmund Winston Pettus, whose mother was a Winston) was ensign.

He was a judge and an uncle to Patrick Henry (ref. letter of Peter Francisco,a foundling discovered on the wharf at City Point, Hopewell Va who was turnedover to Judge Anthony Winston and was raised by the Judge and his family. Hebecame a Revolutionary War hero.)Judge Winston lived in Buckingham County at his home "Hunting Tower" locatednear the vilage of New Store. A description of his home is found in the book "ACourthouse Burned" by Pennington and Scott. A scale model of it is at theclerks office Buckingham County. His arm was known as "Huntington."He represented Buckingham County in the House of Representatives atWilliamsburg in 1765 when Patrick Henry was opposing the Stamp Act imposed bythe British.Tax list indicates death year and widow and 3 children (tithables)

Winston Family 

 (For Winston data from local records see Vol. III., page 1065 et seq.)  The origin of the Winston family in Virginia has been greatly confused by the constant repetition of traditions which have no basis in fact. We will not attempt here a critical examination of these traditions, but relying on the data afforded by the extant records, give what appear to be the facts relative to the family's beginnings in Virginia.  

The first of the name in Virginia (thus far discovered) was William Winston , of St. Peter's Parish, New Kent County , living there as early as 1687 .* York County records in 1666 and 1667 .* William Winston patented land in New Kent County in 1687 , 1690 , 1691 , 1696 and 1701 .* William Winston died in New Kent County prior to February, 1702/3 , leaving issue at least one son:* Anthony Winston , of New Kent County , of whom hereafter.

Anthony Winston , of New Kent County , made a deed there to Thomas Bradley in February 1702/3 ; and had a patent for land in St. Peter's Parish, New Kent , October, 1701 .* December 4, 1725 .*  

1. Anthony Winston , of St. Paul's Parish, New Kent County , died between 1717 and 1719 .
2. Isaac Winston , of St. Paul's Parish, New Kent and Hanover Counties , died 1760 ; of whom hereafter.

The statement that Anthony Winston (died between 1717 and 1719 ), and Isaac Winston (died 1760 ), were brothers, and sons of Anthony Winston , of New Kent , who died Dec., 1725 , is based on the following facts:

1. Isaac Winston , of Hanover County , in his will dated Feb. 6, 1760 , probated March 6, 1760 , makes bequest of a negro "unto my cousin, Nathaniel Winston ."*

2. Nathaniel Winston , in the record of his marriage to Jemima Bell , in 1749 , (in the record book of Henrico County Monthly Meeting of Friends)* Nathaniel Winston , son of Anthony Winston , of Hanover County ."

3. The term cousin was in Colonial times applied in describing nephews and nieces.

4. In March, 1734 , one Isaac Winston, Junior , of St. Martin's Parish, Hanover , conveyed to Nathaniel Winston , of St. Paul's Parish, Hanover , "land devised by Anthony Winston , in his will dated 1717 , to his son, the said Isaac Winston .*

5. The records of St. Paul's Parish, New Kent (later Hanover) County , show that one Anthony Winston was living there, and owned lands therein, from 1708-1715 . In 1719 it appears that Anthony Winston 's orphans were represented at the processioning of lands in that parish by Isaac Winston .*

6. Thus we find that one Anthony Winston had sons, Nathaniel and Isaac Winston ; while a certain Isaac Winston (dying in 1760 ) names "cousin [nephew] Nathaniel Winston " in his will.

7. Note that Isaac Winston (son of Anthony ), in making deed in 1734 , is called "Isaac Winston, Jr. ," while the orphans of Anthony Winston were represented in 1719 by an Isaac Winston . It seems clear that Isaac (son of Anthony ) was called, in 1734 , Isaac Winston, Jr. , to distinguish him from another and older, Isaac Winston .

8. As it is clear that Nathaniel and Isaac Winston, Jr. , were sons of Anthony Winston , who died between 1717 and 1719 , and as Nathaniel was "cousin" [nephew] of Isaac Winston , who died in 1760 ; it is evident that Isaac Winston, Jr. , was so called in order to distinguish him from his uncle, Isaac Winston .

9. It is apparent from the above that Anthony Winston (who died between 1717 and 1719 ), and Isaac Winston (who died in 1760 ), were brothers.

10. While it is not proved, it seems reasonably certain that Anthony Winston (who died 1717-1719 ) was a son of Anthony Winston , of New Kent , who died Dec., 1725 .

Therefore, in view of all the facts recited above, we tentatively place Isaac Winston (died 1760 ), of Hanover County , as son of Anthony Winston , of New Kent (died Dec., 1725 ), and grandson of William Winston , of St. Peter's Parish, New Kent , who died prior to February, 1701/2 .

Isaac Winston (probably son of Anthony Winston ), of St. Paul's Parish, New Kent , later Hanover, County , who died in February or March, 1760 , was long a prominent resident of that section. Isaac Winston appears as owning land in St. Paul's Parish as early as January, 1708 . His name appears with the land processionings and road clearings in that parish in 1712 , and in 1711 he was himself named as a processioner of lands.* 1720 the county of Hanover was erected from the upper part of New Kent and the territory comprised within the boundaries of St. Paul's Parish fell within the new county. From its erection in 1720 until his death in 1760 , Isaac Winston continued a resident of Hanover County . As early as February, 1721/22 , he was a justice of the peace in Hanover ,* October, 1731 , to as late as the year 1744 he is referred to in the records as Captain Isaac Winston .* *

Isaac Winston (died 1760 ), married (according to tradition) Mary Dabney ,*

1. William Winston married Sarah Dabney .

2. Isaac Winston , of whom hereafter.

3. Anthony Winston , born Sep. 29, 1723 ; married Feb. 29, 1747 , Alice Taylor .

4. Lucy Winston married, first, William Dabney ; second, William Coles .

5. Sarah Winston married, first, Colonel John Syme ; second, Colonel John Henry .*

6. Mary Ann Winston married John Coles .

In the name of God Amen. I Isaac Winston of the County of Hanover , being in good health and perfect memory do make and ordain this my last will and testament, and do hereby dispose of all such worldly goods as it hath pleased Almighty God to bestow on me in manner and form following: ºThere is a constant tradition in the Winston family to the effect that Isaac Winston 's wife was Mary Dahney . No record so far discovered throws any light on this question. For data relative to Dabney family obtained from the Virginia records by Mr. Valentine , see Vol. I, pp. 396-429, and this volume, p. 2254.

I give and bequeath unto my son William Winston , one negro man named Ned , bought of John Shelton , also one negro boy named Sandy , to him and his heirs forever.

I give and bequeath to my son Isaac Winston the following slaves, namely, Charles , a man, Tom , a boy, bought of Piron Janes , a woman, and Sam & Grace & Pharrah her children, Miah , a man, and Hager , a woman, Sarah and Doll her child Milly and David children of Leah , Dick , Saul , Jack and Jane his wife and Bradly her child, slaves I give to him and his heirs forever.

I give to my son Isaac Winston , one negro boy named Isaac , provided he shall well and truly pay the sum of forty five pounds current money unto my Grand Daughters Mary and Lucy Coles , daughters of William and Lucy Coles the said sum to be equally divided between my Grandchildren above mentioned when they arrive at the age of twenty one years or marry.

I give and bequeath unto my son Anthony Winston , the following slaves; namely Tamer and Cate , two women and Primus a man now in his possession also Pompey , a man, to him and his heirs forever.

Item: I give and bequeath unto my Grandson Edmund Winston , son of William , one negro girl named Pegg , daughter of Hannah , and a mulatto girl named Tamer daughter of Kate also Abraham , a child of Judy 's with their increase to him and his heirs forever.

Item: I further give unto my said Grandson Edmund Winston son of William fifty pounds current money.

Item: I give unto my daughter Sarah Henry five pounds current money.

Item: I give and bequeath unto my Grandson Isaac Winston , son of Isaac , one negro woman named Aggy , daughter of Hannah and one negro named Tamer , with all their increase to him and his heirs forever.

I give and bequeath unto my cousin Nathaniel Winston , one negro girl named Pegg , a child of Moll with her increase to him and his heirs forever.

I give and bequeath unto my son Anthony Winston , six silver spoons.

I give and bequeath unto Dr. John Walker eighty pounds current money.

I give unto my Grand Daughter Lucy Henry forty pounds current money when she come of age or marries. I give to my Grand Daughter Mary Henry forty pounds current money when she comes of age or marries.

I give unto my Grand Daughter Ann Henry forty pounds current money when she comes of age or marries.

I give unto my Grand Daughter Eliza Henry forty pounds current money when she comes of age or marries.

I give unto my Grand Daughter Susanna Henry forty pounds current money when she comes of age or marries, and my will and desire is that in case either of my grand daughters, namely, Lucy , Mary , Ann , Elizabeth and Susanna Henry or either of them should die before they arrive at full age or marry then it is my desire that the money left to her or them be equally divided between the survivors.

I give and bequeath unto my grand son Walter Coles , son of William Coles , one negro boy named Taff to him and his heirs forever.

I give and bequeath to my loving wife Mary Winston , one negro boy named Ben , also my riding chair and harness and her side saddle and furniture, also her three gilt trunks with one jar as also her bed and furniture as also one negro woman named Hannah provided she will pay unto my son Anthony for the said negro woman fifteen pounds current money within two years after my decease. The slaves and legacies I give unto my said wife Mary and to her heirs forever.

I give to my friend Col. Peter Fontaine fifteen pounds current money provided he will act as executor with my son Isaac .

My will and desire is that after my decease my crop be finished before any of the slaves be delivered to the legatees and that all my crop of Tobacco, corn and wheat, stock and cattle, horses, hogs and sheep, all my household goods of what nature or property soever not heretofore disposed of to be sold by my executors hereafter named at twelve months credit. They taking bond and security of the purchasers and then to collect the debts which may arise from such sale and the sum let out on interest taking good security until the legatees come to age or marry and then it is my desire that my executor hereafter mentioned shall deliver the legatee or legatees a bond or bonds to discharge their specifick legacies together with the interest then due on such bond or bonds without troubling my executors to collect the same.

Item: My will and desire is that the residue of the money arising from the sale of my estate after my just debts and legacies are paid I give unto my son William Winston and to his heirs forever.

Lastly I do hereby appoint and constitute my loving son Isaac Winston and my trusty friend Peter Fontaine executors of this my last will and Testament, and my desire is that no part of my estate be appraised or inventoried, and I do hereby declare this to be my last will and Testament, annuling and making void all former wills by me heretofore made.

At a Court held for Hanover County on Thursday the sixth day of March, 1760 , this last will and testament of Isaac Winston , deceased, was offered for proof by Isaac Winston , one of the executors therein named, and was proved by the oath of John Holden and George Clayton two of the witnesses thereto and also by the oath of the said Isaac Winston as executor thereto and admitted to record.

Isaac Winston (son of Isaac and Mary [Dabney] Winston ) was born in Hanover County between 1715 and 1720 ; died in Henrico County , 1766 .* Isaac Winston moved from Hanover to Henrico about 1740 . In July, 1756 , he qualified to his commission as Major in the Henrico County militia.*

Isaac Winston (circa 1715-20-1766 ), married Mary Ann Fontaine , daughter of the Reverend Peter Fontaine , of Charles City County ,* and had issue:

1. Peter Winston , of whom hereafter.

2. Isaac Winston , of Culpeper County , married, first, Elizabeth Smith ;* Lucy Coles .

3. William Winston .

4. Lucy Winston .

5. Mary Ann Winston .

In the name of God Amen. I Isaac Winston of the County of Henrico of the State of Virginia , being weak of body but of perfect sense and memory, thanks be to almighty God but knowing the uncertainty of this life, I make this my last will and testament in manner and form following:  

I give my soul unto the arms of Jesus Christ my Redeemer and my body to the earth to be buried at the discretion of executors whom I shall hereafter mention, and as to what worldly estate God has been pleased to bless me with I give in manner and form as follows:

I lend unto my dearly beloved wife Mary Ann the use of the house and land whereon I now live, the land purchased by my father of James Pirrant , with her choice of seven negro slaves to be picked out of the slaves at the place whereon I now live. Also one third of my present estate at the said place, which she is to make use of during her life.

Item: I give and bequeath unto my son Peter Winston all the tract of land on Chickahominy Swamp in Henrico Co. that I purchased of William Harris , also all that tract of land on Hickory Creek in Louisa County purchased of Torry & Bearrs , with all the negro slaves at said plantation on Hickory Creek with their further increase and to his heirs forever.

I give and bequeath Isaac Winston all that tract of land I had by my father on the north fork of Pamunkey river in Henrico County , also all that tract of land I purchased of Dickenson adjoining the said tract in Caroline County with all the negro slaves and their further increase on the said plantation to him and his heirs forever.

Item: I give and bequeath to my son William Winston all that tract of land I had in Henrico adjoining the land of James Brittain . Also the two tracts of land on Chickahominy purchased of William Winston and Randolph Bullitt in Hanover and also the tract whereon I now live after his mother's decease, to him and his heirs forever.

I also give and bequeath to my son William Winston his choice of as many slaves as shall make his portion equal with his other two brothers, after his mother has her portion, that my three sons may have as near as may be an equal division of all my slaves to them and to their heirs forever.

My will and desire is that my wife shall also have three young negroes that she shall think proper to chose out of the young negroes that tend about the house, also my chaise and horses during her life.

My will and desire is that my three sons shall have the horses, mares and colts that have already been given them which have been called theirs.

I give to my two sons Isaac and Peter Winston to be divided equally between them all that tract of land on Nottoway river in Lunenburg County that I purchased of Sylvanus Walker to them and each of their heirs forever.

My will and desire is after all my just debts and funeral expenses are paid that all the rest of my estate that I have not already lent away of what kind soever I give to be equally divided between my three sons Peter , Isaac and William and their heirs forever.

My will and desire is that after my wife's decease that the estate I have lent her shall be equally divided between my three sons and their heirs forever.

And lastly, I do appoint my three sons, Peter , Isaac and William Winston , also my friend Thomas Prosser Executors of this my last will and testament revoking all former wills by me made and declaring this to be my last will and testament in witness whereof I have affixed my hand and seal this 14 day of August [1766? ].

Signed, sealed and acknowledged to be the last will and testament of Isaac Winston .

My wife's maiden name was Mary Ann Fontaine .

Peter Winston (son of Isaac and Mary Ann [Fontaine] Winston ) was born November 14, 1741 ; died October 24, 1784 .* He lived at "Half Sink," on the Chickahominy, in Henrico County . Peter Winston was a member of the Henrico County Committee of Safty, 1774 .* The will of Peter Winston was dated October 11, 1784 ; probated December 6, 1784 .

Peter Winston (1741-1784 ) married, December 9, 1767 , Elizabeth (born August 21, 1751 ; died August 1, 1782 ), daughter of John Povall , of Henrico County . (See Povall Family ante page 2301).

Peter and Elizabeth (Povall) Winston had issue:

1. Isaac Winston , born Sept. 18, 1768 ; married, Oct. 1794 , Elizabeth , daughter of William Burton , of Henrico County .

2. Mary Ann Winston , born Aug. 29, 1770 ; married, Dec., 1790 , Alexander Jones , of Amelia County .

3. Peter Winston , born Oct. 8, 1772 ; married, first, Oct., 1791 , Susan Jones , of Amelia County ; second, Dec., 1802 , Nancy C. Jones (sister of Susan , his first wife).

4. Elizabeth Winston (twin of Peter ), born Oct. 8, 1772 ; married June, 1794 , Hezekiah Mosby .

5. Susanna Winston , born Dec. 10, 1774 ; married Anderson Grubbs .

6. John Povall Winston , born Dec. 15, 1776 ; married Susan Austin .

7. Sarah Winston , born May 25, 1778 ; married John Mosby .

8. William Winston , born June 20, 1780 ; married Martha Mosby .

9. Ann Winston , born July 23, 1782 ; died _; married, Oct. 13, 1798 , Benjamin Mosby (1771-1827 ), of Henrico County ; son of Benjamin and Elizabeth (Bacon) Mosby . (See Mosby Family, ante page 2278).

In the name of God, Amen. I Barbara Winston , of the Parish of St. Pauls and County of Hanover do hereby make and ordain this present writing to be my last will and testament in manner and form as follows, that is to say

Imprimis: I give, bequeath and devise unto my son John Winston all that my part of land called Beaverdam , lying in the Parish of Saint Martin and county of Hanover , formerly the land of John Smith , deceased, containing by estimation three hundred acres more or less, to hold the said land to him the said John Winston , his heirs and assigns forever. I do also give and devise to the said John Winston and to his heirs forever one other tract of land which I purchased from one Clark, containing by estimation five hundred acres more or less, lying in Louisa County on both sides of the South Anna River .

Item: I lend unto my said son the said John Winston the following negro slaves, that is to say Hanbury , Poclars , Will , Little Will , Harry , Martin , Savory , Gay , Moses , Polly , Amy , Fanny , Cate daughter of Jack Amey , Perkins , Sarah , Lucy girl, Sarah daughter of Amy , Lyddy , Juno , Sukey , Davey son to Bello , Judy , daughter to Cate and old Jack , to hold the same slaves during his the said John 's natural life and after his death I will that the said slaves be divided among such of the children of said John and in such parts or portions as he by his last will may order and direct.

I also give and bequeath to my said son John Winston all my smiths tools, chain, harness, &c.

Item: I give, bequeath and devise unto my son James Winston and to his heirs forever all that tract lying on the south side of North Anna River , in the County of Hanover , containing by estimation one thousand and four hundred and forty-three acres adjoining the lines of Thomas Prestwood , Hugh Hogan , George Philips and Thomas Carr, Jr .

Item: I lend to my said son James Winston the following negro slaves, that is to say, Michals , Napper , Sam son of Sam , Milly , Daphney , Tom , Hanover , Pharoh , Bitty , daughter of Amy , Lucy , Bello , Sarah daughter of Hamburg , Nanny , Cato daughter to Sam and Aggy daughter to Bello , to hold said slaves during his the said James ' natural life and after his death, I will that the said slaves be divided among such of the children of the said James and in such parts or portions as he the said James shall by his will order and direct.

Item: I give to my grandson William Overton Winston and to his heirs forever two negroes named Christopher and London .

Item: I give to my grandson James Winston , and to his heirs forever one negro boy named Louis .

Item: I give to my grandson John Winston , and to his heirs forever one negro boy named Isaac .

Item: I give to my granddaughter Barbara Winston , and to her heirs forever one negro girl named Tillah .

Item: I give to my granddaughter Elizabeth Winston , and her heirs forever one negro named Jenny Henry .

Item: I give unto my grandson Joseph Winston , and to his heirs forever one negro boy named Armistead .

These six of my grandchildren are the children of my son John .

Item: I give to my granddaughter Elizabeth Winston , her heirs and assigns forever one negro girl named Syby , daughter of Sarah .

Item: I give to my granddaughter Polly Winston and her heirs forever one negro girl named Lucy , daughter to Sarah .

Item: I give to my grandson John Winston and his heirs forever one negro boy named Tom son of Chloe and one other negro named Bristo .

Item: I give to my granddaughter Barbary Winston and her heirs forever one negro named Molly daughter of Belle .

Item: I give to my grandson William Winston and his heirs forever one negro boy named Hamburg son of Sarah .

Item: I give to my granddaughter Molly Winston and her heirs forever one negro girl named Judy , daughter of Milly . These last six grandchildren are the children of my son James .

Item: My will and desire is that all the tobacco and stock of cattle, hogs and crops upon the plantations before herein given be equally divided between my two sons John and James , except the corn which I order to be divided as to support all the negroes on the said plantations.

Item: I give to my said two sons all my new goods, viz: hoes, nails, axes, twine, salt, &c., and all the money I have in my house and in England to be divided equally between them.

Item: I give to my son John Winston all the crops of what kind soever growing or being on my dwelling plantation at the time of my death or that year made there, also my stock of cattle, hogs and sheep belonging to my said dwelling plantation as also my Bible and a book called Josephus, all my silver spoons and my great looking glass and all my pewter, brass, copper, bell mettle and iron belonging to my said plantation at the time of my death.

Item: I give to my two sons John and James two feather beds, bedsteads, blankets, coverlets, quilt, sheets, pillows, pillow cases, towels and napkins and all my taned leather in the vats or out of them as also my horses and mares to be equally divided between them.

Item: I give to my son James Winston my great trunk and one other large old trunk, my writing desk and one folding table and one set of shoe tools and all the rest of my books.

Item: I give to my son John one set of shoe tools and I will that my still be for the common and mutual use of my sons and their heirs.

My will is that in case either of my two sons should die intestate that the negroes herein lent them, or either of them shall be equally divided between the children of such intestate.

Item: Whereas I have not named several young negroes in this my will that do belong to me, I will, order and direct that all such of my slaves as are not herein named be equally divided between my said two sons to be held by each of them in the same manner respectively as the other slaves herein before lent to them, and after their death to be given or divided in the same manner among their children respectively, and in case any of the negroes before named lent to my sons should happen to die before me, in that case I will and direct that the place and value of the slave so dying be supplied and made good out of the young negroes not herein named or that may happen to be born from any of the negroes herein named before my death.

Item: That all the rest and residue of my estate real and personal I give and bequeath to be equally divided between my two sons and their heirs forever.

Lastly my will is that my estate be not appraised and I do appoint my two sons John Winston and James Winston executors of this my last will and testament hereby revoking all former wills by me heretofore made and confirming and establishing this for my last will. In witness whereof I have hereunto set my hand and seal this sixth day of October one thousand seven hundred and sixty-four . Barbara Winston .

At a Court held for Hanover County on Thursday 1, day of January, 1767 , this last will and Testament of Barbara Winston deceased was offered to proof by John Winston one of the executors therein named and was proved by the oath of John Longan and [Maria?] Kimbrough two of the witnesses thereto and also by the oath of the said executor and ordered to be recorded. Test: William Pollard , C. H. C. Copy Test: Philip B. Winston , C. H. C.

Among the possessions of the Winston descendants of Mrs. Barbara (Overton) Winston was a copy of "Josephus,"* referred to in Mrs. Winston 's will, and by her bequeathed to her son, John Winston . This volume contained entries of births, deaths and marriages of members of the Overton and Winston families. The volume descended through several generations to William Overton Winston , of Hanover County , and was finally lost in the fire which destroyed "Courtland," his home in Hanover County , in 1888 .

Fortunately, however, copies had been made of the family records kept in this old volume.* The following data are from the copies of the records made in the volume called "Josephus."

William Overton , born in England , December 3, 1638 ; married Mary Waters , November 24, 1670 . Emigrated to America .
