PATRICK MAXWELL OF NEWARK

Patrick Maxwell of Newark is the son of George Maxwell of Newark. His date of birth is not certainly known but he was probably of perfect age when the Lords of Council recognised him as the son and heir of his deceased father 26 January 1484-85. It is certainly true that minors could not be held liable in law for their actions, and, if as seems likely, he had already reached the age of majority before this date, then it might reasonably be suggested that he was probably born before 26 January 1464. The Murder of Alexander Hamilton of Auchinhowy, younger

On 5 December 1530 Patrik Maxwell of Newark, William Stirling of Glorat, Mariot Maxwell, Lady Bardowie, Andrew Stirling of Banker, John and Stephen Spreull, Thomas Colquhoun of Kirkton, and John Colquhoun, his brother, were all required to find surety for their attendance at the Justice-aire of Dumbarton to underly the law for intercomuning with Alan Hammiltoun of Bardowy, Alan Graham and Hugh Grey, rebels at the horn for art and part of the slaughter of Alexander Hamilton, young Laird of Auchinhowy, and Keffane Williamsoun, his servant. Death

A date of death has not so far been identified for Patrick Maxwell of Newark. He was alive on 18 April 1541 NRS: GD220/1/F/6/5/3 but it seems quite likely that he died before 4 November 1567, by which date his son George appears to have succeeded to Newark. NRS: RH6/2101

Marriage

Patrick Maxwell of Newark married Mariote Crawford. They were married before 9 January 1498-99. RMS: 2473

9 January 1498-99: Charter by which the Steward of Scotland confirms possession to Patrick Maxwell of Newark and Mariote Crawfurd his wife, of the eight merk land of Auchintiber, the four merk land of Clowok, and the forty shilling land of Estir-Kilbride, in the barony of Finlawstoun-Maxwel and sheriffdom of Renfrew. Patrick Maxwell of Newark had previously resigned these lands for a new grant for him and his wife. Patrick and Mariote were to hold in conjunct fee and liferent, and possession was to descend to the heirs male of their bodies, whom failing to Patrick heirs. 17 April 1520: Patrick Maxwell of Newark is noticed at Edinburgh on 17 April 1520, in the witness list of an instrument narrating that John Campbell of Little Senox, depute of the Sheriff of Ayr, siting as judge in the tollbooth of Ayr, continued a brieve of tutory for James Nesbyt.
