In depositions given in a lawsuit, Dixon v. Wingfield, a fight over a slave, we have Thomas Wynne's age as about 62 in 1757, and Martha age as near 60 in 1757. This concurs with the notice of Martha Wynne's death in the Albemarle Parish register.
Lawsuit Wingfield vs Wingfield: “John Wingfield, John ..arton and Mary his wife, Thomas Dixon and Judith his wife, Richard Huson and Elizabeth his wife, Thomas Wynne and Martha his wife, Joel Wingfield, Joshua Wingfield, Martha Wingfield, and Peter Wingfield by Mary Wingfield their mother and protector which said Joshua, Martha and Peter are infants under the age of twenty one years and children of Edward Wingfield deceased and which said Edward Wingfield was and the said John Wingfield, Martha ??, Judith Dixon, Elizabeth Huson and Martha Wynne are the children of Gervas Wingfield late of this county deceased. That the said Gervas Wingfield being in his life time and at the time of his decease possessed a considerable personal estate consisting of sundry valuable slaves and other things departed this life on or about the ...... day of March one thousand seven hundred and fifty six Intestate leaving Hannah Wingfield his widow and relict and William Wingfield his oldest son and heir at law.

His father Thomas Wynne was the older son of Robert Wynne Jr. and Mary Poythress, b 1657 Charles City Co. VA. In 1678 he inherited substantial property in England from his father, but he continued to live in VA.Thomas and his brother Joshua were Indian interpreters. In 1703 the Nottoway and Meherrin Indians petitioned that he be named their interpreter, and he acted to prevent colonists from settling on their land around Bear Swamp.
